(c) The location, extent and intensity of the proposed use shall be such that its operation will <br />not be objectionable to nearby dwellings by reason of greater noise, smoke, dust, odors, fumes, <br />vibrations or glare than is normal or is permitted by the performance standards of the district; <br />(d) The proposed use shall form a harmonious part of the Business and Industrial District <br />taking into account among other factors, convenience of access and relationship of one use to <br />another; <br />(e) The proposed use shall be permitted in a more restrictive district than in which it is <br />permitted by right only because of its limited extent, modern equipment and processes; and <br />(f) The hours of operation and concentration of vehicles in connection with a proposed use <br />shall not be more hazardous or dangerous than the normal traffic of the district. <br />(g) Conditional uses located in business or industrial districts shall comply with the <br />regulations of the zoning district for the parcel of land upon which they are located Wireless <br />communication towers are not restricted to properties already containing a conditional use and <br />shall comply with Chapter 1167. " <br />SECTION 5: That Section 1126.06 of the Zoning Code, which currently reads as <br />follows: <br />"1126.06 PROCEDURE FOR "MINOR CHANGES." <br />(a) Definition. "Minor changes" means: <br />1) Proposed slight modifications in approved applications for building permits, <br />which are requested following final. approval of an application under this <br />chapter; and <br />2) Proposed slight alterations to existing buildings, parking areas ar other <br />improvements whose construction is governed by this chapter. <br />A modification or alteration shall be considered "slight" if it does not significantly concern <br />or affect the review of the original proposal and the determinations made by the Planning <br />Commission under Section 1126.04, and if it in all respects complies with the zoning, building <br />and all other applicable codes of the City. <br />(b) Procedure. Application for building permits for proposed minor changes in existing <br />development or in approved plans shall be reviewed by the Building Official and either approved <br />or rejected by the Building Official without referral to Planning Commission or action by Council; <br />provided, however, that prior to approving or rejecting any proposal for a minor change, the <br />Building Official shall give written notice to the Chairman of the Planning Commission, the <br />Chairman of the Architectural Review Board, and the Chairman of the BZD Committee of <br />Council. If any of these Chairmen, within seven days of receipt of notice from the Building <br />Official, advises the Building Official that the proposal should not be summarily acted upon by <br />the Building Official, then the Building Official shall refer the proposal to Planning Commission <br />in accordance with the procedure set forth in Sections 1126.04 and 1126.05. " <br /> <br />
