CITY OF NORTH OLMSTED <br />RESOLUTION NO.97-37 <br />BY.• COUNCILMAN NASHAR, COUNCILMAN LIMPERT, MAYOR BOYLE <br />AN RESOLUTION REQUESTING A REVIEW BY THE <br />STATE LEGISLATURE OF OHIO REVISED CODE 4303.29 <br />AS AMENDED, EFFECTIVE NOVEMBER 1, 1994, <br />SUBJECT TO ECONOMIC DEVELOPMENT PROJECT AND <br />DEFINING SPECIFIC LIMITATIONS <br />WHEREAS, on November 1, 1994, the State Legislature saw fit to amend Ohio <br />Revised Code 4303.29 in an attempt to stimulate economic development in the State of Ohio; <br />and <br />WHEREAS, the legislation prior to this amendment based the issuance and transfer of <br />licenses for the purpose of dispensing spirits on the population of said district; and <br />WHEREAS, this amendment allows the transfer of C-1, C-2, D-1, D-2, D-3 and D-5 <br />permits from a municipal corporation or the unincorporated area of a township where the <br />permits of that class exceed the number of such permits authorized, to an economic <br />development project located in another municipal corporation or in the unincorporated area of <br />another township in which no additional permits of that class are allowed due to the population <br />quota restrictions; and <br />WHEREAS, the amendment places the responsibility of determining the viability of an <br />applicant as an economic development project on the Department of Liquor Control; and <br />WHEREAS, this amendment was intended to assist small operators as well as large; <br />and <br />WHEREAS, the amendment requires that all licenses transferred under the economic <br />development project clause would have to remain at the business address as issued but may be <br />transferred to another operator at said address; and <br />WHEREAS, the amended legislation is unclear as to the participatory responsibilities of <br />the districts; and <br /> <br />
