WHEREAS, it is the opinion of North Olmsted City Council that transfers under the <br />act as now constituted aze neither advisable nor in the best interest of the City of North <br />Olmsted; and <br />WHEREAS, this Resolution constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfaze. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That North Olmsted City Council hereby requests that the State <br />Legislature review Ohio Revised Code Sec. 4303.29 for the purpose of clarifying the <br />responsibilities and rights of the district under this act. <br />SECTION 2: That the duties of the district under this act be specified to submit <br />findings as to the qualifications of the applicant prior to reviewing an application as an <br />economic development project. <br />SECTION 3: That the act be amended to establish the following: <br />(a) That a limit (cap) be prescribed for the number of transfers into a district <br />under this act as a percentage of the number authorized in a district <br />before the enactment of said amendment. <br />(b) That a limit be established defining the percentage projection of alcohol <br />sales to total sales for any business wishing to qualify for a license <br />transfer as an economic development project. <br />SF.rTlON 4: That the act specify that under the transfer rights of licenses under the <br />economic development project amendment, the business classification for which the license <br />was transferred be retained for the license to remain in effect. <br />SF.['TION S: That the act specify that the issuance of said transfers under the <br />economic development project amendment will not conflict with any other part of the Code <br />and will allow the electors <br />2 <br /> <br />
