of the Step 2 answer. The Mayor or his designee, shall meet at a mutuaily agreed <br />satisfactory time with the Local Union Grievance committes to consider the grievance within <br />seven (7) working days foliowing receipt of the appeal. A representative of Ohio Councii 8 <br />may participate in any such meeting. The Mayor or his designee will answer the grievance <br />in writing within seven (7) working days fo!lowing completion of the Step 3 discussions. The <br />affected employee shall be required to attend the aforementioned meeting. <br />Ail Step 2 or 3 meetings under the grievance procedure shall be scheduled during the <br />last forty-five (45) minutes of the work day uniess otherwise mutuaily agreed to by the <br />parties. <br />Step 4: If the grievance is not satisfactorily setUed at Step 3, the Union may, within <br />(30) calendar days after receipt of the Step 3 answer submit the matter to arbitration. The <br />Uninn shall notify the City of its intent to appeal the grievance to arbitration in writing. <br />Promptly thereafter, representatives of the City and the Union shall meet for the purpose of <br />attempting to select an arbitrator by agreement. !f they cannot so agree, the Union shall <br />send written notice of its intent to arbitrate the grievance to the Federal Mediation and <br />Conciliation Services. If the Union does not send this notice to the Federal Mediation and <br />Conciliation Services within ninety (90) days of notifying the City of its intent to arbi#rate a <br />grievance, then the grievance shall be considered withdrawn. The Federa( Mediation and <br />Conciliation Services shall submit a panel of seven (7) arbitrators to each patty and the <br />arbi#rator shall then be chosen in accordance with Association's then applicable rules. The <br />fees and expenses of the Arbitrator, the meeting room and stenographic service shall be <br />borne by the losing party. The affected empfoyee shall be required to attend the <br />aforementioned meeting. <br />Section 3. In the event a grievance goes to arbitration, the Arbitrator shall have jurisdiction only <br />over disputes arising out of grievances and the Arbitratar shall have no authority to add to, subtract <br />ems:opeiuJafl-cao <br />98KNOLM.WPD 7 <br />
