ARTiCLE 43 - COMMERCIAL DRiVER'S L{CENSE <br />Section 1. Empioyees in ciassifications which required a commercial driver's license (CDL) as <br />? <br />of July 18, 1992 shall be required to maintain a CDL. Employees transferring into or promoting into <br />these c(assifications shaA have ninety (90) days to obtain a CDL. <br />Section 2. The empbyer shail pay the cost of the commercial driver's license, any endorsemen#s <br />to that license, and any testing necessary to obtain it for all new <br />employees required to obtain the license to perform their duties, and all employees promoted to such <br />positions. The employer's obligation shall be limited to the first test an employee takes, and to the <br />first license helshe obtains. <br />Section 3. In the event that an employes loses his CDL or is not successful in passing the CDL <br />exam, the employer shall place the employee into another ava+lable job he is capabie of performing <br />at his regular rate of pay, provided it #a8s within the new job's wage schedule, or at the top of the <br />new }ob's wage schedule if his regular rate of pay does not fall within the new job's wage schedule. <br />Such placement shall supersede lateral transfers, the posting procedure, and work week or shift <br />preference transfers. <br />Section 4. If no job is available, the employee shall be laid off until such time as a job is <br />avaiiable or until such time as he obtains his CDL, whichever is sooner. Upon ob#aining his CDL, the <br />employee shall be returned to his previous job. <br />Section 5. Employees required to take the driving portion of CDL exam shall be permitted to use <br />a City vehicle for that exam. <br />ARTiCLE 44 - UNIFORMS <br />Section 1. The Ci#y shall within thirty (30) days following the execution of this agreement, poll <br />each member of the bargaining unit regarding their desire to be provided a uniform. For those <br />employees indicating a desire to be provided uniforms, the City shalf continue to provide such <br />uniforms.
