2. Employer has the right to direct, supervise, schedule, and evaiuate, the right to <br />determine ths number of employess, the right to hire, assign, transfer, promote <br />and to discipiine, demote, or discharge, with just cause, the right to establish and <br />enforce rea$onabie rules and policies, the right to lay off because of lack of work <br />or economic necessity, and the right to introduce new or improved methods, <br />equipment or facilities. . . <br />3. Employer has the right to determine the overall methods, process, means and <br />or personnel by which govemmental- operations are <br />to be conducted. <br />ARTICLE 25- SAVINGS CLAUSE <br />Section 1. The Union and the City recognize that North Oimsted is a Home Rule City. <br />Therefore, it is the intent of the City and the Union that this Agreement compiy in every respect <br />with applicable legai statutes and charter requirements, and if it is determined that any provision <br />of the Agreement is in conflict with the law, that provision shall be null and void and shall not affect <br />- the validity of the remaining Articles of this Agreement. ln the event of an unlawful determination, <br />the City and the Union shall mest within thirty (30) days for the purpose of negotiating a lawful <br />altemative provision. Nothing contained in this article shall be construed so as to diminish any right <br />or benefit negotiated by the parties and contained in this Agreement. <br />ARTICLE 26- SUB-CONTRACTING <br />Section 1. The City reserves the right to contract any work that the bargaining unit is <br />unable to perform, due to lack of manpower or equipment. The City does agree to limit <br />subcontracting any work that can be done efficiently; safely, and within reasonable time; such <br />work shall be assigned to the bargaining unit. <br />C <br />ems:opeiu/1794afl-cio -34- <br />.
