. ? ?. <br />effective date of this Ordinance and sha11 conclude, unless otherwise extended by this Council, on the <br />3-month anniversary of the Ordinance's effective date. During said moratorium period, the City sha11 <br />not accept any applications for pernuts, nor issue any permits, which would authorize building or <br />construction activity within the said historic downtown area. <br />SECTION 2: For purposes of this Ordinance, the following terms shall have the following <br />meanings: (1) "historic buildings" sha11 mean any building constructed prior to 1948 and located <br />within the historic downtown area ofNorth Olmsted; (2) "historic downtown area ofNorth Olmsted" <br />shall mean that area of the City within and surrounding the intersections of Butternut/Porter/Lorain <br />Roads as more fully described in the map which is attached hereto and incorporated herein by <br />reference; (3) "building and construction activity" shall mean all of the following activities: razing a <br />historic building, or part of a historic building; constructing an addition to a historic building; <br />constructing a new building or addition to an existing building any part of which will be within fifty <br />(50) feet from a historic building; remodeling the exterior of a historic building; or painting the <br />exterior of a historic building; provided, however, that the term "building and construction activity" <br />shall not include the following activities: routine repairs and maintenance, including repainting a <br />building the same color which it presently is, and conducting any building or construction activity in <br />the interior of a building, which does not alter, or require any alteration of, the exterior of the <br />building. <br />SECTION 3: That the Clerk of this Council be, and she hereby is, directed to send a <br />authenticated copy of this Resolution to each owner of property located within said historic <br />downtown area of North Olmsted at the owner's last known address as shown on the tax duplicate. <br />SECTION 4: That the operation of any ordinance or parts of any ordinance in conflict or <br />inconsistent with any provision of this Resolution are, to the extent of any such conflict or <br />inconsistency, suspended during the effective period of this Resolution. <br />SECTION 5: That this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to enact such legislation to protect and preserve <br />invaluable resources of the City against imminent destruction, and further provided it receives the <br />affirmative vote of two-thirds of all members of council, it sha11 take effect and be in force <br />immediately upon its passage by Council and approval by the Mayor. <br />PASSED: First Reading: // <br />Second Reading: <br />l Third Reading: <br />T <br />2 <br />
