CITY OF NORTH OLMSTED <br />RESOLUTION NO. 98-120 <br />BY.• MAYOR MUSIAL <br />A RESOLUTION DECLARING IT NECESSARY TO REPAIR <br />SIDEWALKS AT THE FOLLOWING RESIDENTIAL <br />PROPERTIES LOCATED IN THE CITY OF NORTH <br />OLMSTED: 6112 STAFFORD DRIVE, 6181 STAFFORD DRIVE, <br />4477 MICHAEL AVENUE, AND 24440 SOUTH OXFORD <br />OVAL, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has been advised by the Administration that sidewalks located <br />at the following residential properties: 6112 Stafford Drive, 6181 Stafford Drive, 4477 Michael <br />Avenue, and 24440 South Oxford Ova1, are in a state of disrepair and constitute a safety hazard <br />to pedestrians; and <br />WHEREAS, Section 1363.07 of the Rea1 Property Maintenance Code requires, among <br />other things, that residential property owners keep their sidewalks in repair, and repair or replace <br />sidewalks with a grade separation greater than one inch, or where surfaces are eroded or pitted <br />to such an extent as to cause a safety hazard to pedestrians; and <br />WHEREAS, the owners of the above-referenced residential properties, even though each <br />has been sent written notice by the Engineering Department during the period April 14, 1998, <br />through August 5, 1998, that they are in violation of the said provision of Sectian 1363.07 and <br />must immediately effect repairs to their sidewalks, have failed to effect the necessary repairs to <br />their sidewalks; and <br />WHEREAS, pursuant to Section 729.01 et seq. of the Ohio Revised Code, the City of <br />North Olmsted is empowered to authorize repairs to said sidewalks and assess the total cost thereof <br />against the lots or lands abutting thereon; and <br />WHEREAS, it is the desire of this Council that the City, in order to eliminate the existing <br />pedestrian safety hazards at the above-referenced properties, effect the sidewalk repairs required <br />at the said residential properties and assess the total cost of the repairs against the lots or lands <br />abutting thereon; and <br />,,_ s?.?.??w?? ??,,, zF?, , w?..,? ? ?,>,????? .?-r??..a? ?? . ?,??.? ??..??s .?? a?:??.??•t?,??r.
