?. : ' . _ WHEREAS, plans, specifications, and cost estimates for the said sidewalk repairs have been filed with the Clerk of Council prior to the adoption of this Resolution; NOW9 THEREFORE, BE IT RESOLVED BY THE COUNCII. OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND 5TATE OF OHIO: SECTION 1: That that the plans, specifications and cost estimates for the repairs to the sidewalks abutting upon the residential properties at 6112 Stafford Drive, 6181 Stafford Drive, 4477 Michael Avenue, and 24440 South Oxford Oval, are hereby approved. S?E ?"TION 2: That repairs to the sidewalks abutting upon the said residential properties shall be made by the owners of these properties in accordance with the specifications on file in the office of the Clerk of Council. SECTION 3: That the repairs shall be made by the said owners within thirty (30) days from the date of service of notice upon said owners, as provided for in Section 729.03 of the Revised Code. SF,CTION 4: That, in the event said si.dewalks abutting upon the above-referenced residential properties are not repaired by the owners in accordance with the plans and specifications on file with the Clerk of Council and within the time prescribetl in this Resolution, the City will repair the sidewalks and assess the cost thereof against the lots and lands abutting thereon. SECTlO S: That the Clerk of Council be and is hereby directed to immediately serve notice of the passa.ge of this Resolution upon the owners of the properties located at 6112 Stafford Drive, 6181 Stafford Drive, 4477 Michael Avenue, and 24440 South Oxford Oval by certified mail addressed to such owners at their last known addresses or to the addresses to which tax bills are sent. Such notice sent by the Clerk shall also set forth the place where the specifications governing the repair of such sidewalk aze on file, the time within which the owner of such lot or parcel may repair such sidewalks in accordance with such specifications, and that, in the event such owner does not repair such sidewalks in accordance with such specifications and within such time, the City will repair the sidewalks, and assess the costs thereof against the lot or land of such owner. SEC7701V 6: That this Resolution be and is hereby declazed to be an emergency measure immediately necessary for the preservarion of the public health, safety and welfare, and for the further reason that it is immediately necessary to effect repairs the sidewalks located at 6112 Stafford Drive, 6181 Stafford Drive, 4477 Michael Avenue, and 24440 South Oxford Oval, because each presents a safety hazard to pedestrians; and further provided it receives the affirmative vote of two-thirds of all members of Council, it sha11 take effect and be in force immediately upon its passage and approval by the Mayor. 2
