g. Employees in the appointed position of Dispatcher/Driver shall perform all Dispatcher <br />responsibilities as determined by the Employer. <br />h. Employees in the appointed position of Dispatcher/Driver may be required by the <br />Employer to act as training instructors for new bus operators, retrain current operators or <br />to perform other functions of a training/class nature. When required and assigned to <br />function as a training instructor, a DispatcherlDriver shall be paid an additional $.40 <br />per-hour additionai to his hourly rate as delineated in (e) above, for each hour he actually <br />performs work as a training instructor. The Employer reserves the right to not assign a <br />Dispatcher/Driver as a training instructor and retains it's option to use other operators, <br />management or another agency for training purposes. Both parties recognize and agree <br />that the Federal Transit Administration, the GCRTA or another agency, may establish and <br />dictate future training methods, certifications, locations, etc. that the employer would have <br />no control over. <br />Section 34.05 Night Shift Premium-Maintenance Employees <br />Effective August 1, 1997: The employer shall pay a twenty (20) cents per hour night shift premium. <br />The night shift premium shall be paid to ali fult-time maintenance staffthat are sctteduled and work a <br />night shift. Both parties agree that the current night shift hours, on two shifts established by the <br />Employer, fall approximatety between 5:00 p.m. and 7:30 a.m. However, the Employer retains the <br />right to eliminate and/or change night shift hours and schedules as operational need and conditions <br />require. If a nigfit shift maintenance employee is asked to work overtime immediately following the <br />completion of his scheduled night hours, he shall be paid at a time & one-half rate based upan his <br />regular hourly rate without a night shift differential for all overtime work performed. <br />Section 34.06 Effective July 1, 1998; Equipment Mechanics, who have successfully completed <br />the required Air Conditioning classes and re,ceived the required Certifications, shall receive an <br />additional twenty (20) cents per hour for all hours worked. If an Equipment Mechanic is decertified <br />or fails to receive upgraded Air Conditioning certifications when required, then the additianal twenty <br />(20) cents per hour will no longer be paid until recertification occurs. <br />ARTICLE 35 <br />CONFORMITY TO LAW <br />If the enactment of legislation, or a determination by a court of final and competent <br />jurisdiction (whether in the preceding between the parties or in one not between the parties) <br />renders any portion of this Agreement invalid or unenforceable, such legislation or decision shall <br />not affect the validity of the surviving portions of this Agreement, which shali remain in full force <br />and effect as if such invalid portion thereof had not been ineiuded herein. The parties shatl begin <br />negotiating with respect to any provision or provisions of this Agreement determined to be <br />invalid or in violation of law, as specified herein, within thirty (30) days of such determination. <br />31 <br />
