<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98- 5 7 <br />BY: MAYOR NORMAN MUSlAL <br />AN ORDINANCE AMENDING SECTION 941. 01 OF CHAPTER 941 OF THE PUBLIC <br />SERYICES CODE OF THE CITY OF NORTH OLMSTED, IN ORDER TO ELI1WNATE <br />THE SERVICE CHARGE FOR CITY REFUSE PICK-UP AT MULTI-FAMILY <br />RESIDENTIAL STR UCTURES LOCATED WITHIN THE CI7Y. <br />WHEREAS, a request has been made to the City by an owner of a multi-family residential <br />structure to eliminate the present service charge under Section 941.01(C)(2) for refuse pick-up at <br />multi-family residences located in the City; and <br />WHEREAS, the Seivice Director of this City has advised this Council that no owners of any <br />multi-family structures in the City are presently paying said service charge in order to obtain City <br />refuse pick-up, and that therefore no stream of municipal income will be likely affected by any <br />proposed change to Section 941.01(C)(2); and <br />WHF.RF.AS, this Council believes that there is reasonable jusrification for treating multi-family <br />residential property owners different than single-family residential property owners for purposes of <br />providing city refuse pick-up, in light of the following legitimate local governmental goals: promotion <br />of single-family residential ownership in the city; encouragement to recycle and engage in other <br />activities which promote a clean and safe environment; and conserving limited municipal financial <br />resources by passing the costs of refuse pick-up on to property owners, such as multi-farnily <br />residential property owners, who have greater bargaining power with private refuse pick-up services <br />and can obtain such services from the private sector at a reasonable cost; and <br />WHEREAS, this Council nevertheless now wishes to provide said refuse pick-up service to <br />owners of multi-family residences located in the City at no charge to said owners; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Section 941.01 of Chapter 941 (Refuse Collection) of the Codified <br />Ordinances of the City of North Olmsted which presently reads: <br />"941.01 CLASSIFICATIONS ESTABLISHED. <br />(a) There are hereby established three distinct classifications relating to the collection of <br />refuse which shall be designated as follows: <br />Single-family residential; <br />Multi-family residential; and <br />Commercial. <br />
