(4) For failure to obtain the prior approval of North Olmsted as per Subsection 2.01 for a new connection in the Service Area -$100. 00. (5) For failure to obtain the prior approval of North Olmsteci as per Subsection 2.02 for Service Area Sewer Improvements prior to construction -$1,000.00. (6) For failure to comply with any other requirement of the Sewer Service Agrcement -$50.00 per day for each violation, with each day a violation occurs being a separate violation. The aforementioned penalties are in addition to any other penalties imposed by other agencies having jurisdiction and in addition to other measures allowed elsewhere in the Agreement or a11owed by law that may be taken by North Olmsted in response to any non-compliance by Fairview Pazk. In the event that Fairview Pazk deems tha.t any violation for which a penalty would otherwise be imposed occurreci thmugh circumstances beyond its reasonable contrvl to alleviate or abate, then Fairview Park may file an appeal within thirty (30) days of notice of violation to waive a11 or part of the penalty. Said appeal shall be made in writing to both the Mayor and Finance Director of North Olmsted, and sha11 be heard by an Appeals Committee composed of the monitoring Committee plus the North Olmsted Mayor or his designee. A simple majority shall decide the appeal. All penalties are due and payable within ninety (90) days of notice of violation by North Olmsted to Fairview Park. " 4.04 Ca1_^illintion of nuugl OM R Charge Subsection 4.04 is revised as follows: (1) To paragraph (e) of subsection 4.04, add the following additional sentence: "Upon installation of a master flow meter at Mastick Road point of entry if required by Subsection 2.01, then the "Mastick Road Wastewater Flow" shall mean the aggregate wastewater flow from the portion of the Service Area servei by the Mastick Road point of entry during the calendar year, as measured by the master flow meter maintained by North Olmsted at that point of entry as described in Subsection 1.02. " (2) And add a new paragraph (h) to subsection 4.04, which in its endrety, sha11 read as follows: "(h) Upon installation of a master flow meter at the Mastick Road point of entry as described in
