<br />Fairview Pazk Service Area and the Annual Progress Reports required by the Schedule of <br />Compliance Item No. 4 shall be submitted by Fairview Park to North Olmsted a minimum of <br />thirty (30) days prior to the date on which North Olmsted must submit reports to the Ohio <br />Environmental Protection Agency. "The Satellite Sewer Dischazge Control Plan submittals by <br />Fairview Park must also include provisions for supervision of the service area system by a person <br />holding a State Certified Opera.tor License, reporting procedures to North Olmsted for all <br />unpermitted discharges, and updating for North Olmsterl the Service Area Sewer System Map with <br />a list of all addresses connected to the system. " <br />2.01 Connections <br />Subsection 2.0 is revised to read in its entirety as follows: <br />"No connection to the sewer in the Service Areas shall be made until after the issuance of a permit <br />for that purpose by the Fairview Park Engineer. No permit shall be issued by the Fairview Park <br />Engineer until after the applicant for such permit shall have obtained and paid for a Tap-In Permit <br />from North Olmstsd as per Section 911.09 of the North Olmsted Codified Ordinances with such <br />charge at the rate in effect at the time of submittal for a Tap-In Permit for Fairview Pazk, being <br />at the same rate as property in the City of North Olmsted. No connections to the sewers in the <br />Service Area tributary to the Mastick Road point of entry shall be made individually or in <br />aggregate amount which cause an increase in estimated average flow at the point of entry of <br />10,000 gallons per day or more unless Fairview Park shall install a master flow meter at the <br />Mastick Road point of entry. No permit shall be issued for a connection to any sewer in the <br />Service Area if Fairview Park has been notified that the flow from the Service Area exceeds the <br />peak instantaneous flow rate of the daily flow limit under subsection 1.01 or that any <br />governmental authority having jurisdiction in the premises shall have notified Narth Olmsted <br />Sanitary Sewer System. Any permit for the discharge of industrial. wastes as defined by applicable <br />State and Federal laws or regulations ("Industcial Wastes") shali be issued only in accordance with <br />subsections 2.05 and 2.06. <br />2.09 omuliance and Penalties <br />The following new subsection 2.09 of section 2.00 is hereby added to the Service Agreement: <br />"2.09 omnliance and P=1fles <br />Fairview Park shall operate and maintain its sewage facilities in compliance with the terms of this <br />Agreement including the provisions of the Satellite Sewer Discharge Control Plan as described in <br />subsection 1.03. Failure to comply by Fairview Park sha11 result in the following penalties for <br />various acts of non-compliance: <br />(1) For exceeding the maximum instantaneous flow rate at any point of entry, -$50.00 per day, <br />per point of entry. <br />(2) For exceeding the average aggregate flow completed on an annual basis, for each 0.05 million <br />: . <br />?.?.s.: .,. .? ?
