?- <br />CITY OF NOR1'H OLMSTED <br />ORDINANCE NO. 98- <br />BY: MAYOR NORMAN MUSIAL <br />/ }/,6 1? ? <br />ANORDINANCEAUTHORIZING THEMAYOR TO ENTER INTO ANAGREEMENT <br />WITH T'HE NOIZTH OLMSTED CITY SCHOOL DISTRICT FOR THE FItOYlDING <br />OF FUEL TO THE SCHOOL DISTRICT'S BTIS FLEET AND DECLARING AN <br />EMERGENCI( <br />WHERF.,l.S, the City ofNorth Olmsted and the North Olmsted City School District have in <br />the past had an informal agreement with respect to the city fueling the School District bus fleet; and <br />WHEREAS, this Council believes that it is appropriate to set forth in writing the <br />understanding of the parties with respect to not only accessibility to city property but also the cost <br />to be charged to the School District for providing such service. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />agreement on behalf of the City of North Olmsted with the North Olmsted City School District for <br />the providing to the City School District of fueling facilities, all of which will be in accordance with <br />the agreement which is attached hereto and made a part hereof and marked Exhibit A. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to memorialize the understanding between the City <br />of North Olmsted and the North Olmsted City School District, and further provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATIEST.• <br />BARBARA L.
