The parties to this Memorandum of Understanding ("Memorandum"), the City of North Olmsted, Cuyahoga County, Ohio and the North Olmsted City Schoal District, Cuya.hoga County, Ohio muluatly agree to the foliowing pravisions, effective , 1997: 1. The City of North Olmsted hezeby agrees to pertnit the Narth Olmsted City Schoot District to fuel the school district vehicles at the City's Fueling Facility located at the City's Service Garage at 5200 Dover Center Road. 2. The City of North Olmstcd hereby agrees to permit the North Olmsted City School District to purchase road salt, in bulk and at cast, at the City's Service Facility located at the City's Service Garage at 5200 Dover Center Road. Access to the fueling facility shall be for twenty-four (24) hours, seven days a week. However resuictions to thesc hours of access will be as follows: A. No refueling of District vehicles between 7:00 a.m. and 8:00 am. during the "norrnal work week" da.ys of the City of North Olmsted. B. No refueling of Dishict vehicles between 3:00 p.m. and 3:45 p.m. during the "normal work week" days in the City af North Olmsted. C. District vehicles will accord the "right-of-way" to Ciry public safety and service vehiclcs especially in the case of an emergency or urgent necessity. 4. At the end of each month, the City of North Olmsted will invoice the North Olmsted City Schools for moioz fuel(s) pumped during the preceding month. Pursuant to the current standard, the manthly invoicing will include individual vehicle consumption levels, cosrs by vehicle, type of fuel and a cosUinvoice cover sheet showing the summary totals(s) for the month. 5. The monthly charge far motor fuel will be based on the unit cost of the fuel plus (+) the fuel tax as levied by the State of Ohio. In addiaon, the City of North Olmsted wiIl levy a$.15 per gallon service fee to be paid by the North Olmsted City School District, Both pQlitical entities, The City of North Olmsted and the Narth Olmsted Ciry Schaol District are exempt from Federal Eccise T'axes on motor fuels. Each entity will rnaintain current and up-to-date Federal Excise Tax exemption certificates. 6. At the end of each month, the City of North 4lmsted will invaice the North Olmsted City Schools for bulk purchases of road salt. Said invoices maybe included with the invoicing of raotor fuels.
