If the employee refuses the position, the use of authorized line of duty sick <br />leave would terminate; and the employee would have to use their accumulated sick leave. <br />For the purpose of this paragraph, a sudden and accidental injury shall include <br />such incidents as an automobile accident, assault, gun shot wound and the lilce. It may not <br />be considered as sudden and accidental if an injury or incapacitation results from lifting, <br />slipping, tripping or falling. <br />14.3. Any full-time employee of the Police Department who qualifies for benefits <br />under this Section shall be required to pay over to the City any amount received from the <br />Bureau of Workers Compensation as supplemental wages. Further, if at any time the City <br />deternunes, on the basis of inedical evidence, that employee is permanently disabled and <br />will no longer be able to carry on his duties, then the City may terminate payments and <br />insist that employee go on a pension program. <br />14.4. Any employee who qualifies for the b.enefits under this Section, shall not <br />have his accumulated sick time reduced because of a qualified accidental injury which <br />occwred while in the line of duty. <br />14.5. If an employee is abseat on sick leave for more than three (3) consecutive <br />work days, the City shall require the employee to present medical evidence that the <br />employee was under a doctor's care and is able to return to work. The City will review the <br />attendance records of employee.s periodically and at least once in each tlu?ee (3) month <br />period. If it believes that an employee is developing an attendance problem, it will notify <br />the employee in writing that medical evidence will be requireci for absence.s of three (3) <br />days or les.s.
