?,.. .:- <br />CONDITIONS OF AGREEMENT <br />L SCOPE OF PROJECT: The Engineer shall provide engineering services, as <br />required using ordinary engineering practices. The parties have agreed that the <br />completion period shall be one (1) month after the written authorization to proceed <br />is issued by the City, unless a schedule modification is subsequently agreed to. <br />2. COMPENSATION <br />A. The City shall compensate the Engineer for its services as provided in the <br />proposal dated Mazch 4, 1998 (such proposal is attached hereto marked <br />"Exhibit A" and incorporated herein) provided, however that the total amount <br />paid to the Engineer shall not exceed $10,000.00. Payment shall be made for <br />the work described in Section 1 on a monthly basis based on the actual work <br />completed during the previous month. <br />B. In the event the period exceeds two (2) months and the extended period <br />requires the expenditure of additional work hours, the amount of the chazges <br />shall be agreed upon by the Engineer and the City's Director of Public Service. <br />3. CONSITLTANTS It is understood and agreed that the employment of any <br />Consultant the Engineer deems necessary to perform the work shall be contracted <br />by the Engineer only after written approval of such consultant by the City and <br />shall be paid for by the Engineer. <br />4. ASSIGNMENT This Agreement shall not be assigned by the Engineer <br />without written consent of the City. <br />PAGE 2 of 6 <br />
