?. r <br />DECLARATION OF RESTRICTIONS <br />ant "THIS DECLARATION OF RESTRICTIONS is made by GUS GEORGALIS, the "Declar- <br />. <br />WIINESSETH <br />WHEREAS, Declarant is the owner of the real property located in the City <br />of North Olnsted, Ohio, and more legally described as follows: <br />"Situated in the City of North Olmsted, County of Cuyahoga and <br />State ot Ohio, and known as being Sublot No. 132 in The S.H. Klein- <br />man Realty Company's Westwood Subdivision of a part of Original <br />Dover Township Lot No. 6, as shown by the recorded plat in Volume <br />53 of Maps, Page 22 of Cuyahoga County Records, and being 47.17 <br />feet front on the Easterly.,side of Silverdale Road, and extending <br />back from the center line of said Road, 233.02 feet on the Norther- <br />ly line, 228.72 feet on the Southerly line, and havinq a rear line <br />of 47.37 feet, as appears by said plat" <br />and hereinafter referred to as the "Property;" <br />WHEREAS, Declarant wishes, for the benefit of the City of North Olmsted <br />and surrounding and abutting landowners, to restrict the use of the Property <br />under the terms and conditions sec forth herein. <br />NGW, THEREFORE, Declarant, as owner of the Property, for himself, his ? <br />successors and assigns, declares as follows: <br />FIRST: That the Property shall be used exclusively for a parking lot as <br />an accessory use to the adjacent parcels to the south fronting upon Lorain <br />Road and there shall not be erected upon the Property any building. This <br />First Restriction is made for the beneiit of the City of North Olmsted, Ohio, <br />and the owners of property adjacent to the Property, • <br />SECOND: That no drive, driveway or roadway will be installed, con- <br />structed or built on the Property at its boundary with Silverdale Road, North <br />Olmsted, Ohio, and that no vehicular access will be <br />the Property to Silverdale Road. This Second Restrict on is lik wise madeffor <br />the benefit of the City of North Olmsted and the owners of property adjacent <br />to the Property. <br />TFIIRD: Subject to the provisions of Paragraph 4 below, the restrictions <br />and covenants created by this Declaration shall create a perpetual covenant <br />running wi'th the land and shall be bindinq upon the Property and upon <br />Deciarant and its successors and assigns. Further, the restrictions and <br />covenants shall inure to the benefit of the City of North Olmsted and to <br />adjacent landowners. The provisions of the Declaration shall not be amended, <br />terminated or otherwise modified without the written consent of the Declarant, <br />his successor and assigns, as owner of the Property, and the City of North <br />Olmsted, as evidenced by a majority vote of City Council. Prior notice of any <br />proposed amendment, termination or modification shall be qiven in writing to <br />all abutting landowners at least two (2) weeks prior to any such City Council <br />vote. <br />FOURTH: Notwithstanding any provision of this Declaratzon to the <br />contrary, this Declaration shall become effective only at such time as Declar- <br />ant's application for rezoning of the Property from a residential
