CS-1 Rev. 6/1/87 <br />c <br />SBCTION V (Maintenance and Parking) ' <br />That upon completion of said improvement, said City, will thereafter keep seid highway open to <br />traffic at all timea, and <br />(e) Maintain the improvement in accordance with the provisions of the atatutes <br />relating thereto and make emple financial and other proviaiona Por auch <br />maintenance; end <br />(b) Maintain the right-of-way and keep it free of obstructions in a manner eatin- <br />factory to the State of Ohio and hold said right-of-way inviolate for public <br />highway purposes and permit no signs, poatera, billboards, roadaide atands <br />or other private inetallationa within the right-of-way limits; and <br />(c) illace and maintain all treffic control devicea conforming to the Ohio Manual <br />of Uniform Traffic Control Devices on tih3 improvement in compliance with the <br />pi•ovisions of Section 4611.11 snd related sections of the Ohi.o Reviaed Code. <br />(d) Regulate parking in the Pollowing manner: <br />Prohibit parkirig within the limita of the projeat at all timea. <br />SSCTION VI (Right•-of-Way, Utility Rearrangement and Damage and Liability Responaibilitiea) <br />(a) Ttiat all exiating street and public way right-of-way within the City which <br />is necessary for tha ,aforesaid improvement, shall be made available therefor. <br />(b) That the State/City will acquire any additional right-of-way required for <br />i.he const.ruction of the aforesaid improvement. <br />(c) That arrangementa have been or will be made with and agreementa obtained <br />fram all public utility companies whose linea or eLructures will be affected <br />by the eaid improvement and aaid companiee have agreed to make any and sll <br />necesaery plant removals or rearrengements in such a wanner ea to be cleer <br />of any conatruction called for by the plans of said improvement and eaid <br />companies have agreed to make such necessary rearrangements immediately after <br />notification by said City or the Department of Tranaportation. <br />(d) That it is hereby agreed thet the City shall at ita own expense, make all <br />rearrangements of water mains, aervice lines, fire hydrants, valve boxes, <br />sanitary aewers or other municipelly owned utilitiea and/or any appurtenances <br />the,reto, which do not cotpply with the provieions of Directive DH-P-411 <br />inside or outside the corporate limits as may be neceasary to conform to the <br />said improvament and eaid rearrangements ahall be done et euch time ea re- <br />queated by the Department of Transportaiion Engineer. <br />(e) That the construction, raconetructfon, and/or reerrangement of both publicly <br />and privetely owned utilitiea, referred to in subaections (c) and (d) above, <br />ahell be done in such a mannar as aot to interfere unduly with the operation <br />of the cocitractor conetructing tho improvemsnt and all backfilling of <br />trenchea mede necessary by auch utility rearrangementa ahall be perPormed in <br />accnrdance with the provisions of the Ohio Department of Traneportation <br />Construction and Materiel Speciffcationa and ahall be sub,ject to approval by <br />the SLeie. <br />(i') Thrst thu installation of ell utility facilitiea on the right of way ahall <br />conform with the requirementa of the Fdderal Highway Adminiatration Policy <br />and Prucedure Memorandum 30-4 "Utility Relocations and Ad,juatmenta" snd the <br />Department of Transportation's rulea on Utility Accommodation. <br />(g) Thati the City hereby agreeat to accept rdeponsibility for any end all damagea <br />or claima for which it is legally liable arising from tha negligence of <br />its officers, employeea or agents in the performance of the City's <br />obligations made or agreed to in Sectiona (e), (b), (c), (d), (e) and <br />(f) hereinabove. Likewise, The State agreea to accept reaponaibility for <br />anY and all damagea or claime for which it is legally liable arising Prom <br />the negligence of ite officera, employeea or agents in the performance of the <br />State'e obligations made or egreed to in Sections (a), (b), (c), (d), (e) <br />end (f) hereinabove. <br />Page 2 of 3 <br />.?
