CITY OF NORTH OLMSTSD ORDINAiYCE N0. 90-35 BY: MAYOR AND ENTIRE COUNCIL ? ?? AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A NEW SEWER SERVICE AGREEMENT BETWEEN THE CITY OF NORTH 4LMSTED AND THE CITY dF FAIRVIEW PARK, AND DECLARING AN EMERGENCY. WHEREAS, the City owns and operates a sanitary sewer system (the "North OImsted Sanitary Sewer System"), which incIudes a colIection system, Iift stations, a wastewater treatment plant and appurtenances, which system presentIy has the capacity to collect and treat certain wastewater origi- nating outside the City's corporate boundaries; and WHEREAS, included in the District is certain territory within Fairview Park that is being served, or capable of being served, by the North Olmsted Sanitary Sewer System, which territory is herein referred to as the "Service Area"; and WHEREAS, the City of North Olmsted, as part of the requirements of the U.S. Environmental Protection Agency is required to approve an agreement with the City of Fairview Park estabIishing uniform rates for the treatment of sewage; and WHEREAS, the City of North OImsted and the City of Fairview Park have negotiated, over a period of time, and reach an agreement, which is incor- porated in Exhibit "A", which is attached hereto and made a part hereof; and WHEREAS, both Cities are authorized by ArticIe XVII of the ahio Constitution and are fuIIy empowered to enter into such an agreement; and WHEREAS, the proposed Sewer Service Agreement, which has been re- viewed by both Cities has been filed with the CIerk of this Council. NOW, THEREFORE, BE IT QRDAINED BY THE COUNCIL dF THE CITY OF NORTH OLMSTED, CUYAHOGA CQUNTY, AND STATE OF OHIO: SECTION 1: Zt is hereby determined to be necessary for the City to enter into a Sewer Service Aqreement with the City of Fairview Park, Ohio, under which the Service Area will be served by the North Olmsted Sanitary Sewer System (the "Agreement"), which Agreement wiII supersede the Prior
