<br />CITY OF NORTH OLMSTSD <br />ORDINAiYCE N0. 90-35 <br />BY: MAYOR AND ENTIRE COUNCIL <br />? <br />?? <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A NEW <br />SEWER SERVICE AGREEMENT BETWEEN THE CITY OF NORTH <br />4LMSTED AND THE CITY dF FAIRVIEW PARK, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the City owns and operates a sanitary sewer system (the <br />"North OImsted Sanitary Sewer System"), which incIudes a colIection system, <br />Iift stations, a wastewater treatment plant and appurtenances, which system <br />presentIy has the capacity to collect and treat certain wastewater origi- <br />nating outside the City's corporate boundaries; and <br />WHEREAS, included in the District is certain territory within <br />Fairview Park that is being served, or capable of being served, by the <br />North Olmsted Sanitary Sewer System, which territory is herein referred to <br />as the "Service Area"; and <br />WHEREAS, the City of North Olmsted, as part of the requirements of the <br />U.S. Environmental Protection Agency is required to approve an agreement <br />with the City of Fairview Park estabIishing uniform rates for the treatment <br />of sewage; and <br />WHEREAS, the City of North OImsted and the City of Fairview Park have <br />negotiated, over a period of time, and reach an agreement, which is incor- <br />porated in Exhibit "A", which is attached hereto and made a part hereof; <br />and <br />WHEREAS, both Cities are authorized by ArticIe XVII of the ahio <br />Constitution and are fuIIy empowered to enter into such an agreement; and <br />WHEREAS, the proposed Sewer Service Agreement, which has been re- <br />viewed by both Cities has been filed with the CIerk of this Council. <br />NOW, THEREFORE, BE IT QRDAINED BY THE COUNCIL dF THE CITY OF NORTH <br />OLMSTED, CUYAHOGA CQUNTY, AND STATE OF OHIO: <br />SECTION 1: Zt is hereby determined to be necessary for the City to <br />enter into a Sewer Service Aqreement with the City of Fairview Park, Ohio, <br />under which the Service Area will be served by the North Olmsted Sanitary <br />Sewer System (the "Agreement"), which Agreement wiII supersede the Prior
