<br />2.03 Additional Points of Entry. Fairview Park shall not establish <br />any points of entry other than those now existing from Esther Avenue and <br />Mastick Road (as shown in Exhibit A) by connecting or permitting to be con- <br />nected any additional sanitary sewer collection line into the North Olmsted. <br />Sanitary Sewer System without first submitting to North Olmsted a written <br />request by the Fairview Park Engineer stating the proposed peak instantaneous <br />flow rate and daily flow limit at the additional point of entry and any <br />proposed ctianges in the flow rate and flow limit at the existing points of <br />entry and receiving from the Nozth Olmsted Engineer or his designated agent <br />prior written approval of the proposed connection location, flow rates and <br />flow limits. Approval of the North Olmsted Engineer or his designated agent <br />shall not be withheld unreasonably. Upon approval by the North Olmsted <br />Engineer, such a written request shall constitute a part of this Agreement as <br />if set forth herein. If any additional improvements to the North Olmsted <br />Sanitary Sewer System are required in connection with the establishment of an <br />additional point of entry, the cost of such improvements shall be shared by <br />North Olmsted and Fairview Park and shall be made upon such terms and condi- <br />tions as are mutually agreed upon and incorporated in an amendrnent or supple- <br />ment to this Agreement. <br />2.04 Maximum Infiltration. Fairview Park shall maintain, improve <br />and construct all of its wastewater collection facilities for the Service Area <br />so as to reduce anq excess inflow and infiltration in the manner and to the <br />levels (or lower than those levels) required bq the USEPA, the Ohio Environ- <br />mental Protection Agency or any other governmental authority having jurisd.ic- <br />tion in the premises. Infiltration in those sanitary sewers in the Service <br />Area constructed after the date of this Agreement shall not exceed 200 gallons <br />per inch of diameter per mile of length per 24 hours. <br />- 9 -
