i <br />charges shall not be an expense of operating, maintaining and replacing the <br />Joint Use Facilities. <br />2.05 Use for Industrial Wastes. The sewers in the Service Area <br />shall be used for Industrial Wastes only to the same extent permitted and upon <br />the same conditions set forth from time to time in the Codified Ordinances of <br />North Olmsted for the use of sewers in North Olmsted for Industrial Wastes. A <br />copy of Chapter 917 thereof, "Industrial Pretreatment", in effect at the time <br />of execution of this Agreement is attached hereto as Exhibit D. Upon any <br />amendment, modification or enactment of additional requirements, rules and <br />regulations relating to the treatment of industrial wastes, North Olmsted <br />shall promptly provide to Fairview Park copies of such amendment, modification <br />or addition. <br />2.06 Application for Discharge of Industriai Wastes. Any industrial <br />user desiring to discharge Industrial Wastes into the sanitary sewers serving <br />the Service Area shall use a special appiication form prescribed and provided <br />by North Olmsted. The Fairview Park Engineer shall not issue the required <br />connection permit for that industry until and unless the application is sub- <br />mitted to and approved by the North Olmsted Engineer. <br />2.07 Surcharge for Industrial Wastes. Any additional surcharge <br />imposed by North Olmsted for treating Industrial Wastes from the Service Area <br />(which surcharge shall be computed on the same basis as the surcharge for <br />Industrisi Wastes imposed by North Olmsted for treating Industrial Wastes <br />originating in North Olmsted) shall be identified and billed to Fairview Park <br />concurrently with the charges provided for in Section 4.00. <br />2.08 North Olmsted Inspection. Fot the purpose of assuring compii- <br />ance with subsections 2.04 and 2.05, North Oimsted shall have the right to <br />- 11 -
