c r? <br />, ? • <br />perform such tests from time to time as it reasonably deems necessary to <br />determine the amount of inflow and infiltration from the Service Area and to <br />sample the effluent of any Industrial Wastes discharged in the Service Area. <br />Such tests shall be performed at times agreed upon by the North Olmsted <br />Engineer and the Fairview Park Engineer. The cost of such tests shail be an <br />expense of operation, maintenance and replacement of Joint Use Facilities for <br />the purposes of Section 4.00. <br />3.00 North Olmsted Fund. <br />3.01 Sewer Revenue Fund. North Olmsted shall establish and maintain <br />a separate account in its Sewer Revenue Fund designated as the "Sewer Revenue <br />Fund -- Fairview Park Joint Use Account" and may establish and maintain <br />separate subaccounts therein. North Olmsted shall deposit all amounts <br />collected from Fairview Park as OM&R Charges under Section 4.00 or as <br />surcharges for the treatment of IndusLrial Wastes under subsection 2.07 in its <br />Sewer Revenue Fund -- Fairview Park Joint Use Account, and the Sewer Revenue <br />Fund -- Fairview Park Joint Use Account shall be used solely to pay operation, <br />maintenance and replacement expenses of the North Oimsted Sanitary Sewer <br />System. <br />3.02 Joint Use Facilities. "Joint Use Facilities", as used in this <br />Agreement, means (i) the sanitary sewerage collection facilities within North <br />Olmsted which transport wastewater originating in the Service Area ("Joint <br />Collection Facilities") and (ii) the wastewater treatment plant used to treat <br />such wastewater ("Joint Treatment Facilities"). <br />4.00 System of Fees and Charges. <br />4.01 General Provisions. The system of fees and user charges for <br />users within North Olmsted at the time of execution of this Agreement is set <br />- 12 -
