Page 6 <br />. , <br />ARTICLE II <br />RECOGNITION <br />The Employer hereby recognizes the Association as the sole <br />and exclusive bargaining agent with respect to wages, hours, <br />and other term8 and conditions of employment for all full-time <br />Employees in the Fire Department who are members of the <br />Association or are represented by the Association. All other <br />Employees of the Employer's are excluded from the bargaining <br />unit. <br />ARTICLE III <br />EMPLOYER'S RIGHTS <br />3.1 Except as specifically abridged by the express written <br />terms of this Agreement, the Employer shall have all the <br />rights and prerogatives, including, but not limited to the <br />right-ra=.direct Fmployees covered by the Association's <br />iurisdiczion, the right to determine the number of Employees <br />required in the Fire Department, the right to hire, fir_e, <br />assign, transfer, prumote, supervise and evaluate, demote <br />and discipline with just cause, the right to establish and <br />enforce rules not in conflict with the terms of this <br />Agreement, to lay-off because of lack of work or economic <br />necessity, and to introduce new or improved methods, <br />equipment and facilities. 3.2 The above shall be in accordance with Civil Service Rules <br />and Regulations. <br />ARTICLE IV <br />DUES DEDUCTIONS <br />4.1 The Employer agrees to deduct regular monthly Association <br />dues from the wages of those Employees who have voluntarily <br />signed dues deduction authorization forms permitting said <br />deductions. The dues deductions shall be made from the <br />second paycheck of every month. <br />4.2 The Employer agrees to deduct from the salary of any <br />Employee of the Fire Department, who is not a member of the <br />Association, to pay to the Association by way of payroll <br />deduction, a Fair Share Fee, as determined by the Treasurer <br />of the Association but not to exceed the dues paid by <br />Association members.
