3.2 Tt?e conduct and grading of civil service exar.iinations, the rating <br />of candidates, the establishnent of elioible lists from the <br />examinations, and the orioinal appointnents fror? the eligible <br />lists are not appropriate subjects for collective bargaini.ng. <br />3.3 Unless a public Fmployer agrees otherwise in a collective <br />bargaining agreement, nothing in Chapter 4117 of the Revised Code <br />inpairs the right and responsibility of each public Fmployer to: <br />A. Determine matters of inherent manaoerial policy which include, <br />but are not limited to areas of discretion or policy such as <br />the functions and programs of the public employer, standards <br />of services, its overall budget, utilization of technology, <br />and organizational structure; <br />B. Direct, supervise, evaluate, or hire employees; <br />C. Maintain and improve the efficiency and effectiveness of <br />governmental operations; <br />D. Determine the overall methods, process, means, or personnel <br />by which governmental operations are to be conducted; <br />E. Suspend, discipline, demote, or discharge for just cause, or <br />lay off, transfer, assign, schedule, promote, or retai.n <br />employees; <br />F. Detezmine adequacy of the work force; <br />G. Deterriine the overall mission of the Flnployer as a unit of <br />government; <br />H. Effectively manage the work force; <br />I. Take actions to carry out the nissian of the public Enployer <br />as a governmental imit. <br />The Employer is not required to bargain on subjects reserved to the <br />management and direction of governmental unit except as affect wages, <br />hours, terms and conditions of enployment, and the continuation, <br />modification, or deletion of an existing provision of a collective <br />bargai.rLn.g agreement. A public Enployee or exclusive representative may <br />raise a legitimate complaint or file a grievance ba.seci on the collective <br />bargaining agreement. -6- <br />
