8.3 Any Employee who has been laid off shall be subject to the terms <br />and regulations of the Consolidated Onnibus Budget Reconciliation <br />Act (COBRA). <br />8.4 Any Employee laid off and subsequently recalled to work shall <br />return to work with all benefits and privileges previously held <br />provided the same have not been used, including but not limited to <br />seniority, accumulated sick leave, holidays and vacation rionts. <br />8.5 Employee nnist report all address anci telephone chanbes while laid <br />off. <br />8.6 Employee rrnist agree to return to work within 48 hours of recall or <br />lose his right of recall. Employee must return to work within 14 <br />days of the date of recall or lose his right of recall. <br />ARTICLE IX <br />DISCIPLINE AND DISC'tIARGE <br />9.1 P1o Employee shall be disciplined or discharged without just cause. <br />? 9.2 In al.l cases where written and forrial charges have been placed <br />• against Fmployee(s) which could result in loss of duty time, <br />`---? suspension, fine or punishment of any kind, the Friployee shall <br />receive fran the Fire Chief copies of exact charges placed against <br />him at least ten days prior to the effective date of the action. <br />9.3 In any case of discipline or discharge, the Dnployee shall have the <br />right to appeal such action through the Grievance Procedure <br />beginnirg at Step 3. Appeals must be filed: <br />(a) Within thirty days from .the notification of written and formal <br />charges. <br />(b) Within ten days from notification in all other cases. <br />9.4 An Employee against whon Disciplinary or Dischaxge charges have <br />been placed shall, at his option, be allowed to call witnesses to <br />testify at any hearing relating to his Discipline or Discharge. <br />9.5 Failure of the Enployer to confom with the requirements of this <br />Article sha.ll render the Discipline or Discharge null and void. <br />9.6 Failure of the Employee to conform with the requirements of this <br />Article shall result in the Er.iployee relinquishing his rights of <br />appeal imder this article. <br />9.7 71ze tirie limits set forth in this Article may be modified by r,nitua.l <br />1""? <br />written agreement of the Association and the Friployer. <br />-12- <br />_. _ _.._... _ .., V._ .. __ _ ._?.,. _ ,_. . _ .
