If the average cost or premium is establised to be less <br />than $567.50 per month over the (12) twelve months specified, <br />the employee who paid with a payroll deduction contribution <br />shall be entitled to a refund determined by the difference <br />between $567.50 and the actual average cost or premium times <br />twelve (12) ;months. In no event shall the refund be greater <br />than the employee's contribution during the period specified <br />above. <br />Employees who may be entitled to a refund shall receive <br />such refund within thirty (30) days following the <br />determination of the actual average cost for the period July <br />1, 1994 through June 30, 1995. <br />All newly hired employees must have participated in the <br />plan along with a payroll deduction during the entire period <br />to be eligible for a refund. Any employee who changes from a <br />single to a family plan status or vice-versa during the above <br />period shall only be entitled to a refund calculated only by <br />the number of months for which contribution was made. <br />If the actual average cost or premium cost per month <br />exceeds $567.50 per month, the additional amount shall be <br />paid at a ratio of three-quarters (75%) by the City and one- <br />?-? quarter (25%) by the employee. The employee share of the <br />cost which exceeds an average of $567.50 shall be withheld as <br />additional payroll deduction within thirty (30) days <br />following the determination of the actual average cost. <br />Section 4: The employer will establish a committee <br />consisting of (1) one representative from each of the City's <br />bargaining units, if they choose to be represented and a <br />minimum of (1) one representative of the employer. The <br />bargaining units role as a participant in the aforementioned <br />committee shall be advisory only and established for the <br />sharing of and exchanging information, ideas and concerns <br />relating to hospitalization. The employer reserves the right <br />to establish all plans, enrollment periods and regulations. <br />All changes affecting coverage or chosen providers shall <br />be shared with the bargaining unit prior to the making of <br />such changes. <br />Section 5: Expected Cost or Premium is defined as the cost <br />of all medical, hospital, prescription drug costs, and <br />related fees. <br />Section 6: Those employees subscribing to any other plan(s) <br />offered that have different plan year starting and ending <br />periods shall be subject to all terms and conditions F.: <br />described within this Article.
