, <br /> <br /> <br />ARTICLE 31: SAVINGS CLAUSE <br />Section 1: The Union and the City recognize that North <br />Olmsted is a Home Rule City. Therefore, it is the intent of the <br />City and the Union that this Agreement comply in every respect <br />with applicable legal statutes and charter requirements, and if <br />it is determined that any provision of the Agreement is in <br />conflict with law that provision ahall be null and void and shall <br />not affect the validity of the remaininq Articles of this <br />Agreement. In the event of an unlawful determination, the City <br />and the Union shall meet within thirty (30) days for the purpose <br />of negotiatinq a lawful alternative provision. Nothing contained <br />in this article shall be construed so as to diminish any right or <br />benefit negotiated by the parties and contained in this <br />agreement. <br />ARTICLE 32: SUB-CONTRACTING <br />Section 1: The City shall meet and confer with the Union <br />prior to sub-contracting out barqaininq unit work, other than <br />emergency work. In the event a subcontract causes a lay-off, the <br />City will make every reasonable attempt to provide an opportunity <br />of employment with the subcontractor for said laid off bargaininq <br />unit employees. <br />Additionally, any sub-contracting of work shall not result <br />in a layoff, for a period of 1 year, after the date of the sub- <br />contract. <br />40
