_ i <br /> ARTICLE 43: COMMERCIAL DRIVER'S LICENSE <br />?.` <br /> Section 1: Employees in classifications which required a <br /> commercial driver's license (CDL) as of July 18, 1992 shall be <br /> required to maintain a CDL. Employees transferring into or <br /> promoting into these classifications shall have ninety (90) days <br /> to obtain a CDL. <br /> Section 2: The employer shall pay the cost of the <br /> commercial driver's license, any endorsements to that license, <br /> and any testing necessary to obtain it for all new employees <br /> required to obtain the license to perform their duties and all <br /> employees promoted to such positions. The employer's obligation <br /> shall be limited to the first test an employee takes and to the <br /> first license he obtains. <br /> Section 3: In the event that an employees loses his CDL or <br />? <br />is not successful in passing the CDL exam, the employer shall <br /> place the employee into another available job he is capable of <br /> performing at his regular rate of pay, provided it falls within <br /> the new job's wageschedule, or at the top of the new job's wage <br /> schedule if his regular rate of pay does not fall within the new <br /> job's wage schedule. Such placement shall supersede lateral <br /> transfers, the posting procedure, and work week or shift <br /> preference transfers. <br /> Section 4: If no job is available, the employee shall be <br /> laid off until such time as a job is available or until such time <br /> as he obtains his CDL, whichever is sooner. Upon obtaining his <br /> CDL, the employee shall be returned to his previous job. <br />46
