<br />. • ' . <br />CITY OF NORTE[ OTMSTED <br />ORDINANCE N0. 92- 73 <br />BY: COUNCILMAN LIND <br />AN ORDINANCE ArEiVDING SECTION 915.04 of THE OODIFIID ORDINANCES OF <br />THE CITY OF NORTH OLMSTID T0 ESTABLISH REVISID USIIt CHARGFS TO BE <br />LEVIID AND ASSFSSID UPON EACH IAT, PARCII, OF LAND, BUILDING OR <br />PREMISES HAVING ANY SEWIIt CONNECTION WITH THE MUNICIPAL SANITARY <br />SEWERAGE SYSTENI, PROVIDING AMOUNTS TO BE CiARGID FOR IlOUSTRIAL <br />WASTE SURCHARGES PURSUANT 1'0 CHAPTIIt 915 OF 1HE CODIFIID ORDINANCFS <br />AND IlNDUSTRIAL PRFTRF.ATMENT PROGRAMS FEES PURSUANT TO SECTION <br />917.04 OF TI3E CODIFIID ORDINANCES, REPEALING ORDINANCE N0. 85-6 AND <br />DECLARING AN IlMEItGIIVG'Y. <br />WHERFAS, the City of North Olmsted awns and aperates a sanitary <br />sewerage system servi.ng the residential, commercial and industrial users <br />of the City and certain users autside the municipal oorporation; and <br />wF-ERFAS, the City of North Olmsted i.s required by the Ohio <br />Environmental Protection Agency to make certain improvements to the <br />system, including improving the existing municipal wastewater treatment <br />facilities (the "Project"); and <br />WiBaMS, pursuant to the documents necessary for financing of the <br />CAy's share of the Project cost, the City will be required at all times <br />to prescribe and charge user rates for the services and maintenance <br />thereof, for proper improvement arxl replacement reserves and for <br />sufficient earnings coverage for the debt service m the revenue bonds <br />and any additional bonds that may be issued fran time to time; and <br />WHEREAS, this Council, previously passed Ordinance No. 85-6 an <br />January 30, 1985 to establish user rates for this purpose. <br />NOW, THEREFORE, BE IT ORDAINED gY THE COUNCIL OF TIiE CITY OF NORTH <br />OLMSTED, STATE OF OHIO: <br />SECTION 1: Ihat Section 915.04 of the Codified Ordinances of the <br />City is hereby amended to read in full as follows: <br />"915.04 User Charges <br />(a) All premises within the corporation limits of the City of <br />North Olmsted, Ohio, shall pay a sewer user charge based upon <br />the quantity of water used on the premises as shown by the <br />records of the Division of Water of the City of Cleveland, <br />unless specified otherwise in this Chapter.
