Page 3 <br />(d) The user charges for users outside the City limits shall be <br />determi.ned (i) as to the City of Fairview Park, in accordance with <br />the ternLS of an Agreement between the City and the City of Fairview <br />Park (as successor to the Village of Parkview), dated as of April 3, <br />1962, as amended and supplemented fran time to time, and (ii) as to <br />Olmsted Township, in accordance with the terms of an Agreement <br />between the County of Cuyahoga (the "County") and the City, dated as <br />of April 15, 1965, as supplemented by the First Supplemental <br />Agreement between the City and the County, dated as of May 23, 1974, <br />as each may be aanended and supplemented from time to time; provided, <br />however, that prior to placing into operation municipal wastewater <br />treatment facilities financed by United States Environmental <br />Protection Grant No. C391665-03 such agreements between the City and <br />the City of Fairview Park and the City and the County shall be <br />amended, consistent with prior determinations and the provisions of <br />40 CFR Sections 35.935-13(c) and 35.929-2(g), made applicable by <br />conditions of the aforesaid Grant, as may be necessary to insure <br />that each recipient of wastewater treatment services provided by <br />the City wi71 pay its proportionate share of the costs of operation, <br />maintenance and replacement of the system and may be otherwise <br />amended to provide for payment of a portion of debt service charges <br />incurred by the City to pay costs of the system." <br />SECTION 2: For purposes of deternLn;ng the industrial waste surcharges <br />imposi-d by Chapter 915 of the Codified Ordinances, the following unit rates of <br />charge shall apply for removal of excess biochemical oxygen demand (BOD) and <br />suspended solids (TSS) effective with all bills rendered duri.ng the periods <br />indicated: <br />Year BOD TSS <br />1992 $0.32/lb. $0.37/lb. <br />1993 $0.34/lb. $0.39/lb. <br />1994 #0.36/lb. $0.41/lb. <br />1995 and after $0.38/lb. $0.43/lb. <br />SECTION 3: Consistent with Section 917.04 of the Codified Ordinances, <br />the following fees shall be reflected on bills rendered to each industxial <br />waste dischaxger'served by the system during the periods indicated to pay <br />costs of the City's pretreatment program: <br />Year <br />1992 <br />1993 <br />1994 <br />1995 and after <br />Cost Per Year <br />$600 <br />$630 <br />$660 <br />$700 <br />SECTION 4: That existing Section <br />Ordinance No. 85-6, passed January 30, <br />hereby repealed. <br />915.04 of the Codified Ordinances and <br />1985, shall be and the same are
