The above comparison with NOMBL and GCRTA employees is for the purpose <br />of establishing pay rates, only. Job descriptions and responsibilities are <br />different between the two operations. <br />See attached Exhibits A-1 to A-6; which sets forth the wage schedules. <br />Section 34.02. Operators who are assigned a training operator shall be <br />paid an additional forty cents ($.40) per hour for the time spent with the <br />training operator and shall be required to rate and evaluate the training <br />operator. <br />Section 34.03. There is an established operator training program which <br />shall not exceed thirty (30) days and any operator who is included within <br />said training program shall be paid the then established federal minirmum <br />hourly wage rate, for the hours spent in training. All road instruction <br />shall be conducted by only full-time operators. <br />ARTICLE XXXV <br />CONFORMITY 'Ii0 LAW <br />If the enactment of legislation, or a determination by a court of final <br />and competent jurisdiction (whether in the preceding between the parties or <br />in one not between the parties) renders any portion of this Agreement <br />invalid or unenforceable, such legislation or decision shall not affect the <br />validity of the surviving portions of this Agreement, which shall remain in <br />full force and effect as if such invalid portion thereof ha.d not been <br />included herein. The parties sha.ll begin negotiating with respect to any <br />provision or provisions of this Agreement determined to be invalid or in <br />violatian of law, as specified herein, within thirty (30) da.ys of such <br />determination. <br />ARTICLE XXXVI <br />TERM OF AGRFEMEnrr <br />The term of this Agreement sha.ll be from August 1, 1991 to <br />July 31, 1994 , and it shall continue from yearta year beyond <br />the original term hereof unless either party notified the other in writing, <br />not later than sixty (60) days prior to the initial expiration date or the <br />expiration date in subsequent years, of its desire to modify or amend this <br />Agreement. <br />ARTICLE XXXVII <br />COPY OF AGREIIKIIVT <br />The Employer shall furnish copies of this Agreement to each NOTEA <br />member in the NOMBL at no charge. <br />-28-
