withheld during the second pay of each month, along with an accounting as to <br />the amount withheld from the pay of each employee, specifically identifying <br />Association members and those employees paying a fair share. <br />Section 4.03. All requests for cancellation of payroll deductions for <br />dues shall be processed through the NOTEA's Treasurer. All approved <br />cancellations will be forwarded to the City's Director of Finance with a <br />request for cancellation. _ <br />Section 4.04. The NOTEA agrees to hold the Employer harmless from any <br />and all liabilities or damages which may arise from the performance of its <br />obligations under this Article and indemnify the Employer for any such <br />liabilities or damages that may arise. <br />ARTICLE V <br />MANAGEMENT RIGHTS <br />Section 5.01. Except as specifically abridged by the expressed written <br />terms of this agreement, the Employer should have a11 rights and prerogatives, <br />including, but not limited to the following: <br />l. Determine a11 ma.tters of inherent managerial policy which includes, but <br />are not limited to, areas of discretion or policy such as the functions <br />and programs of the employer, standards of service, its overall budget, <br />utilizatian of technology, and organizational structure. <br />2. Employer has the right to direct, supervise, schedule, evaluate, the <br />right to determine the number of employees, the right to hire, fire, <br />assign, demote, transfer, promote and right to discipline with just <br />cause, the right to establish and enforce rules and policies not in <br />conflict with the terms of this agreement, the right to lay off, <br />because of lack of work or economic necessity and to introd.uce new or <br />improved methods, equipment and facilities. <br />3. Employer has right to determine the overall methods, process, means and <br />or personnel by which governmental operations are to be conducted. <br />Section 5.02. The operator nm schedules are provided by the Greater <br />Cleveland Regional Transit Authority and are subject to their regulations in <br />the distribution and configuration of these runs. <br />ARTICLE VI <br />NOTEA RIGHTS <br />Section 6.01. The NOTEA membership shall ha.ve the exclusive right to <br />choose their representative according to the provisions of the Constitution <br />and Bylaws of the NOTEA. <br />Section 6.02. <br />(a) The Service Director or his designee shall meet at least once <br />monthly with the NOTEA representatives, at mutually agreeable times, <br />to discuss problems and policies as they relate to established <br />Transit policies and procedures. Ad.ditional meetings may be called <br />my mutual agreement at the request of either party to discuss mutua.l <br />problems. <br />(b) NOTEA representatives shall give advance notification to the <br />Service Director, or his designee, of the topics to be discussed and <br />vice versa. <br />-2-
