Section 4.03. All requests for cancellation of payroll deductions for dues shall be processed through the NOTEA's Treasurer. All approved cancellations will be forwarded to the City's Director of Finance with a request for cancellation. _ Section 4.04. The NOTEA agrees to hold the Employer harmless from any and all liabilities or damages which may arise from the performance of its obligations under this Article and indemnify the Employer for any such liabilities or damages that may arise. ARTICLE V MANAGEMENT RIGHTS Section 5.01. Except as specifically abridged by the expressed written terms of this agreement, the Employer should have a11 rights and prerogatives, including, but not limited to the following: l. Determine a11 ma.tters of inherent managerial policy which includes, but are not limited to, areas of discretion or policy such as the functions and programs of the employer, standards of service, its overall budget, utilizatian of technology, and organizational structure. 2. Employer has the right to direct, supervise, schedule, evaluate, the right to determine the number of employees, the right to hire, fire, assign, demote, transfer, promote and right to discipline with just cause, the right to establish and enforce rules and policies not in conflict with the terms of this agreement, the right to lay off, because of lack of work or economic necessity and to introd.uce new or improved methods, equipment and facilities. 3. Employer has right to determine the overall methods, process, means and or personnel by which governmental operations are to be conducted. Section 5.02. The operator nm schedules are provided by the Greater Cleveland Regional Transit Authority and are subject to their regulations in the distribution and configuration of these runs. ARTICLE VI NOTEA RIGHTS Section 6.01. The NOTEA membership shall ha.ve the exclusive right to choose their representative according to the provisions of the Constitution and Bylaws of the NOTEA. Section 6.02. (a) The Service Director or his designee shall meet at least once monthly with the NOTEA representatives, at mutually agreeable times, to discuss problems and policies as they relate to established Transit policies and procedures. Ad.ditional meetings may be called my mutual agreement at the request of either party to discuss mutua.l problems. (b) NOTEA representatives shall give advance notification to the Service Director, or his designee, of the topics to be discussed and vice versa. -2-
