Section 6.03. Whenever conferences or meetings are scheduled by the <br />Employer during regular daytime working hours, participating NOTEA <br />representatives will incur no loss of regular pay. <br />Section 6.04. The NOTEA shall be permitted the use of two (2) loeked <br />bulletin boards for posting of notices concerning official NOTEA business. <br />One board to be located in drivers room and second in service personnel area. <br />Section 6.05. Whenever in the performance of his duties and in carrying <br />out the responsibilities thereof, an an employee becomes the object of legal <br />action directed against him, the Fmployer will provide the concerned with <br />legal advice a,nd representation. <br />ARTICLE VII <br />NO STRIKE/NO LOCKOUT <br />Section 7.01. Neither the NOTEA nor any member of the bargaining unit, <br />for the duration of this Agreement, shall call, sanction, encourage, finance, <br />participate or assist in any way in any strike as that tenn is defined in <br />Ohio Revised Code 4117.01(H). <br />Section 7.02. It is further agreed that any violation of the above <br />shall be sufficient grounds for immediate disciplinary action, which may <br />include termina.tion. <br />Section 7.03. It is further agreed that during the term of this <br />Agreement, the Fmployer shall not lockout any Transit Enployee. <br />ARTICLE VIII <br />GENEftAL WORKING CONDITIONS <br />Section 8.01. No employee shall be required to perform a duty that is <br />in violation of any applicable state law, City ordinance, or any rule or <br />regulation issued by arry federal, state or local regulatory agency, board or <br />commission. <br />Section 8.02. No employee i.s to be required to perform any hazardous or <br />abnormally strenuous activity which a healthy employee could not be <br />reasonably expected to perform. <br />Section 8.03. No employee shall be scheduled to work alone in the <br />garage, barring an emergency or an unusual situation. If this situation <br />oceurs, a supervisor will make every attempt to call in an additional <br />employee as soon as it can be arranged. <br />Section 8.04. No employee shall be held responsible for the non- <br />performance of any task that is left undone because of the lack of proper <br />tools, equipment or supplies. <br />Section 8.05. Operators shall have access to the washrooms in the <br />drivers roan at all times during their shifts. Any result of vandalism or <br />abuse be it intentional or as a result of negligence may result in <br />disciplinary action. <br />-3-
