M <br />Ordinance 92 - 14 - 2 - <br />Disconnection of Downspouts <br />(b) Splash down of any roof water directly upon the <br />ground shall not be permitted if not approved by the <br />City Engineer. <br />(c) In the event that inspection indicates that certain <br />downspouts, yard drains or similar drains have not been <br />correctly disconnected from the sanitary sewer, and after <br />the expiration of the time limit in the notice for disconnection, <br />the names of the owners then in violation of Section 911.12 and/or <br />Section 911.19 shall be forwarded to the City Prosecutor for <br />appropriate action. <br />(d) In the event the owner of such premises fails to comply with <br />the requirements of the notice from the City Engineer or Building <br />Comm.issioner, the City or its authorized agent may enter upon such <br />premises and cause the violations to be corrected. <br />(e) In the event the City deems it necessary to enter such <br />premises to perform the work required to correct the violation, as <br />per the notice from the City Engineer or Building Commissioner, <br />the City shall first give written notice of such intent by <br />certified mail to the owner or by posting a copy of the notice on <br />the premises to comply with the requirements of this chapter within <br />the time specified in such notice. <br />In case of failure or refusal of such owner to comply with the <br />notice and the requirements of this chapter, the work required <br />thereby may be done at the expense of the owner by the City. <br />The City shall determine the amount paid for such work and shall <br />ascertain the description of the property on which the work was <br />done. The amount paid for such work and the description of the <br />property shall be certified to the Auditor and shall be entered <br />upon the tax duplicate, become a lien upon such lands from the date <br />of entry, and shall be collected as other taxes and returned to the <br />City for deposit in the General Fund. In the alternative, the <br />City may recover the amount of money so expended for such work <br />from the owner before any court of competent jurisdiction." <br />SECTION 2: Any ordinance or part of ordinances inconsistent <br />herewith are hereby repealed. <br />SECTION 3: This ordinance shall take effect and be in force from <br />and after the earliest date allowed by law.
