I.-, <br />",-, <br />M. Neither the GRANTEE nor the City shall tap or monitor or arrange for the <br />tapping or monitoring, or permit, either expressly or implieci, anyother ' <br />person to tap or monitor any cable, line, signal input device, or Subscriber <br />outlet or receiver or any purpose whatsoever, without the express written <br />permission of the Subscriber, except as required for routine maintenance <br />of the System, routine operation of the System, polling with audience <br />participation, judicial order, audience viewing surveys to support . <br />advertising research regarding viewers where individual viewer behavior <br />cannot be identified or except as required during the technical standard <br />`inspection as required by the terms and conditions described in this <br />Agreement. <br />In the conduct of providing its services or pursuit of any collateral <br />commercial enterprise resulting therefrom, GRANTEE shall take any and <br />all necessary action to prevent an invasion of a Subscriber's right to <br />privacy as such right is defined by applicable law. GRANTEE shall not <br />without lawful court order utilize the System's interactive two-way <br />equipment or capability for unauthorized personal surveillance of any <br />Subscriber. <br />The GRANTEE shall not sell or otherwise make available to unaffiliated <br />third parties, lists of the names and addresses of Subscribers, or <br />any list which identifies, by name, Subscriber viewing habits or <br />personalized data pertaining to a Subscriber's use of any of <br />GRANTEE's services without the express written consent of the <br />Subscriber to which the personalized data pertains. For the purposes of <br />the Section, "personalized data" shall mean the name and address of an <br />lndividual Subscriber directly associated with data obtained on his or her <br />use of specific services provided by or through the GRANTEE. Nothing <br />herein shall be construed to prevent, as a normal incident of commercial <br />' enterprise, the sale or availability of "non-personalized" or "aggregated <br />data" which is not personalized data as defined herein. <br />n. Except as otherwise required by the FCC Rules for cable television, <br />GRANTEE shall exercise no control over program content on any of the <br />access channels. <br />o. The GRANTEE shall comply fully with the technical rules and standards <br />established by the FCC, and, except to the extent not authorized by State <br />or Federal law, those which may be imposed by the City of North Olmsted. <br />i ;
