<br />(B) The Cable System and ali parts thereof shall be subject to the right of <br />ins ection •b #he Ci . ..: .. . .. .... : . ....•:. ... . .,..... .. ,.: ..:... ..... . :. .. _, ..:... :. . . . . <br />P P Y fy.: . - < :,:. _. : . . .: . . . : . :. . .. <br />(C) The Mayor may, from time to time, issue such reasonabie rules and <br />regulations concerning the construction, operation, and maintenance of the System as <br />are consistent with the provisions of the Agreement and FCC Rules and Regulations. <br />(D) If at any time, the powers of the City Councii or any agency or official of <br />the City transferred by law to any other board, authority, agency or official, then such <br />other board, authority, agency or official shall have the powers, rights and duties <br />previously vested under this Agreement with any agency or official of the City. <br />SECTION XXIV: <br />GRANTEE's DUTY TO REMOVE ITS PROPERTY FROM THE PUBLIC STREETS <br />(A) Following the GRANTEE's commencement of service through its System, <br />the GRANTEE shall promptly remove from the public streets where its properties are <br />located all or any part of its facilities or equipment, so located where one or more of the <br />following enumerated conditions occurs: <br />(1) The GRANTEE ceases operate it system for a continuous period <br />of (6) six months from the date of said occurrence; <br />(2) The GRANTEE fails to construct and or maintain said system as <br />hereinbefore and hereinafter provided; <br />(3) The Franchise is terminated or revoked pursuant to notice as <br />provided in Section Xl hereof; or <br />? (4) The City elects not to renew the franchise at the expiration of this <br />Agreement as provided in Section XI hereof; <br />Providing that the GRANTEE shall be entitled to receive notice in writing from <br />the City setting forth one or more of the occurrences hereinabove enumerated or such <br />other occurrence hereinbefore or hereinafter provided, and that the GRANTEE shall <br />have (180) one hundred eighty calendar days from the date upon which said notice is <br />received to remove said properties as hereinabove required. <br />(8) The Mayor is herein and hereby authorized to enforce the provisions of <br />this Section as hereinafter provided: <br />;-?
