-.-?..,.. . . ... , . .. .,... ,. ..:?.14-..,?,....,.:.... .. <br /> <br />The GRANTEE shall not sell or otherwise make available to unaffiliated <br />third parties, lists of the names and addresses of Subscribers, or any <br />list which identifies, by name, Subscriber viewing habits, or personalized <br />data pertaining to a Subscriber's use of any of GRANTEE's services <br />without the express written consent of the Subscriber to which the <br />personalized data pertains. For the purposes of this Section, <br />"personalized data" shall mean the name and address of an individual <br />Subscriber directly associated with data obtained on his or her use of <br />specific services provided by or through the GRANTEE. Nothing herein <br />shall be construed to prevent, as a normal incident of commercial <br />enterprise, the sale or availability of "non-personalized" or "aggregated <br />data" which is not personalized data as defined herein. <br />n. Except as otherwise required by the FCC Rules for cable television, <br />GRANTEE shall exercise no control over program content on any of the <br />access channels. <br />o. The GRANTEE shall comply fully with the technical rules and standards <br />as established by the FCC, and, except to the extent not authorized by <br />State or Federal law, those which may be imposed by the City of North <br />Olmsted. <br />SECTION VI: <br />GENERAL INDEMNIFICATION AND LIABILITY INSURANCE <br />A. The GRANTEE agrees by the acceptance of this Franchise to indemnify, keep <br />and save the City, its employees and representatives free and harmless from liability <br />on account of injuries or damages to Persons or property arising out of the <br />GRANTEE's construction, installation, operation, maintenance, repair or use of the <br />Cable System, except for those injuries or damages which result from the sole or <br />contributing negligence of the City, its employees, agents or representatives. In the . <br />event that suit shall be brought against the City, its employees or representatives, <br />either independently or jointly with the GRANTEE on account thereof, the GRANTEE <br />upon notice by the City, its employees or representatives, shall defend the City, its <br />employees or representatives in any such suit at the full and total cost of the <br />GRANTEE, and, in the event of final judgment being obtained against the City, its <br />employees or representatives, either independently or jointly with the GRANTEE, the <br />GRANTEE shall indemnify the City, its employees or representatives and pay such <br />judgment, with all costs including pre-judgment and/or post judgment interest and <br />hoid the City, its employees or representatives harmless therefrom. <br />13
