<br />4. <br />5. <br />? <br />Operations of emergency override system, station monitoring <br />system and standby powering system, if any. <br />Visual evaluation of all channels leaving the headend. <br />6. All headend and system evaluations shall be made against the <br />FCC technical specifications in effect at the time such evaluation <br />is made. <br />k. The independent consultant, if one is engaged, shall provide a written <br />report detailing objective technical findings supporting objective and <br />subjective conclusions to the City. The report will use the simple school <br />grading system of: A= Excellent / B= Good to excellent / C= Good / D= <br />Fair to poor / E= Poor / F= Failing in rating objective findings. <br />Should it be determined as a result of the proof-of-performance technical <br />inspection and evaluation that any equipment used in the operations of <br />the system is not in good condition, working order and repair, such <br />equipment shall be repaired or replaced. The GRANTEE shall repair or <br />replace such equipment within (45) Forty-five days after having <br />knowledge of such equipment. This (45) forty-five day evidence of time <br />may be modified by the City upon request and satisfactory reason by the <br />GRANTEE. <br />m. Neither the GRANTEE nor the City shall tap or monitor or arrange for the <br />tapping or monitoring, or permit, either expressly or implied, any other <br />person to tap or monitor any cable, line, signal input device, or <br />Subscriber outlet or receiver for any purpose whatsoever, without the <br />express written permission of the Subscriber, except as required for <br />routine maintenance of the System, routine operation of the System, <br />polling with audience participation, judicial order, audience viewing <br />surveys to support advertising research regarding viewers where <br />individual viewer behavior cannot be identified or except as required <br />during the technical standard inspection as required by the terms and <br />conditions described in this Agreement. <br />In the conduct of providing its services or pursuit of any collateral <br />commercial enterprise resulting therefrom, GRANTEE shall take any and <br />all necessary action to prevent an invasion of a Subscriber's right to <br />privacy as such right is defined by applicable law. GRANTEE shall not <br />without lawful court order utilize the System's interactive finro-way <br />equipment or capability for unauthorized personal surveillance of any <br />Subscriber. <br />i2
