<br />r I 1 I <br />f <br />(o) "Gross Revenue" Shall mean any and ali compensation in whatever form, <br />exchange or otherwise derived by the "GRANTEE" from Subscribers for the provision <br />of Cable Service, as defined in the Cable Act from the operation of the "Cable System°" <br />as defined within this Agreement and all other compensation derived from, but not <br />limited to subleasing office space and equipment located in the Franchise area to <br />non-affiliates, net local advertising sales and interest on subscriber deposits (unless <br />such interest is returned to the Subscriber). This term does not include any sales, <br />excise or other taxes or fees collected by GRANTEE on behalf of any state, city or other <br />governmental unit, and shall be net of bad debt, refunds to Subscribers and copyright <br />fees. <br />(p) "Mayor" Shall mean the Chief Executive Officer of the City or any person to <br />whom the Mayor designates the authority to act. <br />(q) "Normal Service Intervals" Shall mean the period between the time that <br />the GRANTEE is notified by a Subscriber or the City of a service deficiency, the <br />GRANTEE shall by (24) twenty-four hours following receipt of such deficiency notice, <br />(thirty-two (32) hours when notice is received by GRANTEE prior to noon) commence <br />correcting such deficiency; providing that the Subscriber or representative is available, <br />during this period, at the premises or location to be serviced. <br />Complaints received by the GRANTEE concerning partial or complete system <br />outages affecting more than five (5) Subscribers shall be acted upon promptly and in <br />no event more than (2) finro hours after the GRANTEE becomes aware of the <br />aforementioned outages. <br />(r) "Peg Access Channel" Shall mean the channel or channels on which <br />"Peg Access" programming is cablecast. <br />(s) "Peg Access Equipment" Shall mean equipment provided by the <br />GRANTEE, which is necessary for the production and presentation of cablecast <br />programs other than automated services, including technical assistance, and the <br />GRANTEE shall permit its use for the production and presentation of public access . <br />programs to persons residing within the City of North Olmsted. <br />(t) "Person" Shall mean any individual or association of individuals, or any <br />firm, corporation partnership, government, or other business entity. <br />(u) "Reasonable Request" Shall mean a written request by the City, delivered <br />to the GRANTEE via Certified U.S. Mail which request shall, taking into account all <br />relevant facts and circumstances, be reasonable on its face. <br />? <br />J
