<br />ORDINANCE NO. 96-155 <br />BY: Mayor Boyle <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE <br />ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AMENDMENTS TO SECTION 4 OF ARTICLE III, AND <br />SECTION 3 OF ARTICLE IV OF THE CHARTER OF NORTH <br />OLMSTED TO PROVIDE FOR AN AMENDMENT TO THE <br />METHOD OF SUCCESSION TO THE OFFICE OF MAYOR IN <br />THE EVENT OF ABSENCE OR A VACANCY IN THE OFFICE <br />OF MAYOR, AND DECLARING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, County of <br />Cuyahoga, Ohio, two-thirds of all members concurring that: <br />SECTION 1. Pursuant to Article XVIII, Section 9 of the Ohio Constitution, and <br />Article XII of the Charter of the City of North Olmsted, this Council authorizes and directs that the <br />following proposal to amend the Charter of the City of North Olmsted be submitted to the electors <br />of the City of North Olmsted at an election to be held at the usual places of voting in the City on <br />Tuesday, November 5, 1996: <br />That existing Section 4 of Article III and Section 3 of Article IV be amended to read <br />as follows: <br />Article III <br />The Mayor <br />SEC. 4 VACANCY IN THE OFFICE OF THE MAYOR <br />(a) Absence. When the Mayor is absent or inaccessible, and, as a result, is unable to <br />perform a duty or duties required of him by this Charter or by ordinance, the Director of Public <br />Service, if he is qualified by Article III, Section 2, of this Charter to be Mayor, shall become the <br />Acting Mayor and shall perform such duty or duties during the period of time that the Mayor is <br />absent or inaccessible. In the event that the Director of Public Service is not qualified, or is absent <br />or inaccessible, then the Director of Public Safety shall become Acting Mayor, provided he is <br />qualified by Article III, Section 2, of this Charter to be Mayor. In the event that the Director of <br />Public Safety is not qualified, or is absent or inaccessible, then the President of Council shall <br />become Acting Mayor. The Acting Mayor shall perform such duty or duties of the Mayor for only <br />such period of time that the Mayor continues to be absent or inaccessible and, as a result, is unable <br />to perform that duty or those duties.
