NORTH OLMSTED CHARTER 6 <br />ARTICLE III <br />THE MAYOR <br />SEC. 1. TERM. <br />The Mayor shall be elected at the regular municipal election in the .year 1961, and <br />every second year thereafter, for a term of two (2) years. His term shall commence <br />and he shall assume office on the first day of January next following such election. <br />(Adopted 11-8-60. ) <br />SEC. 2. QUALIFICATIONS. <br />The Mayor shall have been a qualified elector and a resident of this City for at least <br />two (2) years immediately prior to the date of his election, and shall continue to be a <br />qualified elector and resident therein during his term. He shall not serve on continuoua <br />active military service in excess of one. (1) month, either state or national, nor shall he <br />hold any other public office or public employment, except that of notary public or member <br />of the State Militia, National Guard or Reserve Corps of the United States. <br />SEC. 3. REMOVAL. <br />The Council may remove the Mayor for his disqualification while in office, for hia <br />conviction while in office of a crime involving moral turpitude, or for a violation of his <br />oath of office provided, however, that such removal shall not take place without the con- <br />currence of twn-thirds of the members elected to Council nor until the Mayor shall have <br />been notified in writing of the charge against him at least ten (10) days in advance of any <br />hearing upon such charge and he and his counsel have been given an opportunity to be <br />heard, present evidence, and examine any witness appearing in support of such charge. <br />SEC. 4. VACANCY IN THE OFFICE OF MAYOR. <br />(a) Absence. When the Mayor is absent or inaccessible or is unable for any cause <br />or reason to perform his duties, the President of Council shall become the acting Mayor, <br />but he shall not thereby cease to be President of Council. <br />(b) Vacancy. In the event the office of Mayor shall become vacant for any reason, <br />the President of Council shall thereupon become the Mayor, and serve for the unexpired <br />term or until the beginning of the term of a successor duly elected as hereinafter pro- <br />vided, and his office as President of Council shall become vacant. <br />(c) Absence of President of Council. In the event the President of Council shall be <br />absent or inaccessible or for any reason unable to perform his duties as acting Mayor, <br />then Council, by a,vote of a majority, shall designate one of their number to act as Mayor. <br />~. <br />
