9 NORTH OLMSTED CHARTER <br />„;, <br />(c) Acting Manor. In the absence of the Mayor, the President of Council shall act as <br />Mayor as provided in Article III of this Charter. <br />(d) Vacancy in Office. In case of a vacancy, the President of Council shall be elected <br />by the Council from among its members and the one so elected shall vacate his office as <br />Councilman and shall serve for the unexpired term of such President of Council. <br />SEC. 4. REMOVAL. <br />The Council shall be the judge of the election and qualifications of its own members. <br />Council may by at least atwo-thirds (2/3s) vote of all of its members eligible to vote <br />expel or remove any member for gross misconduct, malfeasance, nonfeasance, misfeasance <br />in or disqualification for office; for the conviction while in office of a crime involving <br />moral turpitude; for persistent failure to abide by the rules of Council; or for absence <br />without justifiable excuse from three consecutive regular meetings thereof. Prior to any <br />action by Council, the member whose removal is sought shall be notified in writing of the <br />charge or charges against him at least ten (10) days prior to a hearing upon such charge <br />or charges and he shall be given the opportunity to secure counsel and to be heard. He <br />shall be given the opportunity to present any evidence that he may deem necessary in his <br />defense and to examine under oath any witness appearing in support of the charges brought. <br />SEC. 5. VACANCIES. <br />Whenever any office of Councilman becomes vacant, the vacancy shall be filled by <br />`" appointment for the unexpired term by a majority vote of the remaining members of <br />Council eligible to vote. If Council does not fill said vacancy within thirty (30) days, <br />the Mayor shall appoint a Councilman to fill said vacancy. <br />SEC. 6. SALARIES AND BONDS. <br />The Council shall have the power to fix its own compensation and the compensation of <br />each employee of the City, including officers and members of any board or commission <br />of the City, whether elected, appointed or chosen, and to establish bond for the faithful <br />discharge of the duties of the office. The premium of any bond required by Council shall <br />be paid by the City. The compensation of all elected officials shall be fixed at least <br />thirty (30) days prior to the filing date of nominating petitions for the terms beginning on <br />the next succeeding first day of January, and shall not thereafter be changed in any <br />respect during any such term or part thereof. <br />~~. SEC. 7. MEETINGS. <br />(a) Regular Meetings. The Council shall meet in the Council Chamber at such <br />times as may be prescribed by its rules, regulations, ordinances or by-laws, however, <br />not less than twice during each calendar month, excepting that Council may provide for <br />its vacation period during the months of July or August, and during such period is subject <br />to the call of the Mayor. All meetings of Council, whether regular or special, shall be <br />open to the public . <br />(b) ~cial Meetings. Special meetings of Council may be called in accordance with <br />°~~~ the rules and regulations or by-laws adopted by Council.
