CITY OF NORTH OLMSTED <br />ORDINANCE NO. 61 - /~~ <br />~ 1 ~.~ <br />AN CfftDTNANCE ESTABLISHING RATES TO BE CHARGED TO R.ESIDEIdrS <br />WITHIN SHF~OOD FSPATES SUBDIVTSTON FOR SERVICES OF THC <br />CITY OF NORTH OI~+iSTED IN OPERATIAIG THE SANITARY SEWERAQS <br />SYSTEM t7TILITY OPERATED BY THE CITY FOR SAID StTBDIVISION. <br />WHEREAS, the developer has constructed a sanitary sewage treatment <br />plant and system within said subdivision to collect and treat sanitary sewage <br />developed therein in accordance with the ordinances of the City arul in accord- <br />ance with the regulations established by the State of Ohio for standards to be <br />rnet by such a system, and <br />AREAS, the developer, in accordance with the improvement plans <br />heretofore approved by the City, upon completion of the plant and its operation <br />serving residents within said subdivision have been complied with and the plant <br />turned orer to the City for management and operation, it now becomes necessary <br />for the City to establish rates to be charged residents within said subdivi- <br />sion and served by said system representing the costs to the City for the man- <br />agement, maintainanee~ and operation of the plant and system, and <br />WHEREAS, Council has requested the report by the City Engineer <br />estimating the operating costs, maintainance and repair, insurance, chemicals, <br />and pow~arca-anption of said plant, and upon review of said report and a dis- <br />cussion of said report with the Service Director, deems it necessary at this <br />time to fix the present rate to be charged for the services of the sanitary <br />sewage system utility of the City, which monthly rate will be charged and <br />collected quarterly by the City from the premises utilizing the services of <br />said utility and which rate shall remain in effect until otYa~rwise revised <br />b9 Council, <br />NOW, THERF~E, be it ordained by the Council of the City of North <br />O7.wsted, State of Ohio <br />Section 1: That it is hereby determined and declared to be necessary <br />for the due protection of the public health, safety and welfare of the City of <br />North Olmsted to establish and col:Lect charges for the use of the sanitary sew- <br />age system upon all the lots and lands and premises served by or having connec- <br />tion with the sanitary sewage system within the Sherwood Estates Subdivision, <br />Section 2: That tYie .funds received from the collection of the rates <br />and charges hereafter provided from premises within Sherwood Estates Subdivision <br />shall be paid over sa received to the Director of Finance trho Shall keep the <br />same in a separate fund designated as "Sherwood Estates Sexage Rsvenu~e Fund. <br />Subject to the provisions of any ordinances of the City, and when connected to <br />and becoming a part of the City's sanitary sewage treatment syste:a, ar~d upon <br />the use of the City's sanitary sewage treatment plant, said funds then shall <br />be subject to the provisions of the indenture of mortgage authorising the <br />issuance of and securing mortgage revenue bonds for the system. Monies re- <br />ceived in said fund until the aforesaid connection to the City's general san- <br />itary sewage treatment system shall be used for the pay~^ent of the cost and <br />expense of operation, maintainausce, repair and management of the Sherwood <br />Estates sewage system. After connection to the general sanitary sewage system <br />of the City an~q surplus i.xi said fund over and above the requirements h®r®tofore <br />mentioned may be used for payment of debt charges on bonds is:ued for construc- <br />tion of the system and for enlargements of and replacements to the system and <br />parts thereof. <br />Section 3: That for the purposes provided in Section 2 hereof, there <br />is hereby levied and charged upon each lot, parcel of land, or premises having <br />or required to have a connection with the Sherwood Estates sanitary sewage sys- <br />tem or otherwise discharging sewag®, industrial wastes, water or other liquids <br />directly or indirectly into the Sherwood Estates sanitary sewage system, sewer <br />charges in the amounts due and payable as hereinafter. provided: <br />
