CITY OF NORTH OLMSTED ORDINANCE NO. 61 - /~~ ~ 1 ~.~ AN CfftDTNANCE ESTABLISHING RATES TO BE CHARGED TO R.ESIDEIdrS WITHIN SHF~OOD FSPATES SUBDIVTSTON FOR SERVICES OF THC CITY OF NORTH OI~+iSTED IN OPERATIAIG THE SANITARY SEWERAQS SYSTEM t7TILITY OPERATED BY THE CITY FOR SAID StTBDIVISION. WHEREAS, the developer has constructed a sanitary sewage treatment plant and system within said subdivision to collect and treat sanitary sewage developed therein in accordance with the ordinances of the City arul in accord- ance with the regulations established by the State of Ohio for standards to be rnet by such a system, and AREAS, the developer, in accordance with the improvement plans heretofore approved by the City, upon completion of the plant and its operation serving residents within said subdivision have been complied with and the plant turned orer to the City for management and operation, it now becomes necessary for the City to establish rates to be charged residents within said subdivi- sion and served by said system representing the costs to the City for the man- agement, maintainanee~ and operation of the plant and system, and WHEREAS, Council has requested the report by the City Engineer estimating the operating costs, maintainance and repair, insurance, chemicals, and pow~arca-anption of said plant, and upon review of said report and a dis- cussion of said report with the Service Director, deems it necessary at this time to fix the present rate to be charged for the services of the sanitary sewage system utility of the City, which monthly rate will be charged and collected quarterly by the City from the premises utilizing the services of said utility and which rate shall remain in effect until otYa~rwise revised b9 Council, NOW, THERF~E, be it ordained by the Council of the City of North O7.wsted, State of Ohio Section 1: That it is hereby determined and declared to be necessary for the due protection of the public health, safety and welfare of the City of North Olmsted to establish and col:Lect charges for the use of the sanitary sew- age system upon all the lots and lands and premises served by or having connec- tion with the sanitary sewage system within the Sherwood Estates Subdivision, Section 2: That tYie .funds received from the collection of the rates and charges hereafter provided from premises within Sherwood Estates Subdivision shall be paid over sa received to the Director of Finance trho Shall keep the same in a separate fund designated as "Sherwood Estates Sexage Rsvenu~e Fund. Subject to the provisions of any ordinances of the City, and when connected to and becoming a part of the City's sanitary sewage treatment syste:a, ar~d upon the use of the City's sanitary sewage treatment plant, said funds then shall be subject to the provisions of the indenture of mortgage authorising the issuance of and securing mortgage revenue bonds for the system. Monies re- ceived in said fund until the aforesaid connection to the City's general san- itary sewage treatment system shall be used for the pay~^ent of the cost and expense of operation, maintainausce, repair and management of the Sherwood Estates sewage system. After connection to the general sanitary sewage system of the City an~q surplus i.xi said fund over and above the requirements h®r®tofore mentioned may be used for payment of debt charges on bonds is:ued for construc- tion of the system and for enlargements of and replacements to the system and parts thereof. Section 3: That for the purposes provided in Section 2 hereof, there is hereby levied and charged upon each lot, parcel of land, or premises having or required to have a connection with the Sherwood Estates sanitary sewage sys- tem or otherwise discharging sewag®, industrial wastes, water or other liquids directly or indirectly into the Sherwood Estates sanitary sewage system, sewer charges in the amounts due and payable as hereinafter. provided:
