(h'dinance No. 61 - /'' '~ Page 2 (a) For all lots, parcels of land or premises having a connection with'.the sanitary sewer system within Sherwood Estates Subdivision or otherwise discharging sewage, industrial wastes, water or other liquids directly or indirectly into the said system, a charge of $3.00 per month for each of said lots, parcels of land, or premises until the fixing of a different rate determined by Conrail necessary or fair and equitable to the users of said system and subsequently when said system is conr~cted to and becomes a part of the general sanitary sewage treatment system of the City, there will th®n be in effect charges to said premises herein provided for the rates then in effect for premises being served by the general sanitary sewage treatment system of the City and in the manner charged and collected as provided by the ordinances of the City of North Olmsted then in effect. Section 1~: That the sewer charges levied at the rates established in Section 3 shall take effect on September 1, 1961, as to all lots, parcels of land or premises cosuieated to said system and being served by the Sherwood Estates sanitary sewer system, and, as other premises within said aubdivisidn receive service, said rates shall become operative and effective on the first of the month immediately following said connection and servic®, aYxi which rates and charges shall thereafter be billed and become payable in the fol- lowing manners; quarterly, which quarterly billing periods are determi~d to be: The first of April, The first of July, The first of Qet~ober, and The first of January. Any premises becoming subject to such charges on a date between such quarterly billing periods shall be charged a pro rata amount based upon the monthly charge from the first of the month following said connection and service applicable to said premises until the next quarterly billing period. Section ~: That esah sewage charge levied pursuant to the provisi~e of this ordinance is hereby made a lien upon the premises charged thrtrewith ar:d if the same is not paid within 30 days after it is due and payable it shall be certified to the Auditor of Cuyaht~a County, who shall p7.aae the same on the tax duplicate, with the interest and penalties allowed by law, and be collected as other municipal taxes are collected. Section b: That this ordinance is hereby declared to be an emergency measure necessary for the public peas®, health, safety, and ~+elfare of the Gity of North 0]Yasted and for the further reason that the establishment of sewer rates and csharges for the Sherwood Estates Subdivision is essential in order to provide the requisite financing for maintainanae and operation of the Sherwood Estates Subdivision system and plant, and necessary for the preservation of the health of the City and its residents. Section 7: Wherefore, this ordinance shall take immediate effect from and after its passage and approval, otherwise, at the earliest period allowed by law.
