Beech Lane <br />Extension <br />- Beginning at Frank St. and thence north to <br />Maple Ridge Road. <br />- Beginning at the western terminus of Belch <br />Lane and thence northeast and north to <br />Leberne Drive. <br />in accordance with Resolution No. bl - 8, passed January 17, 1961, as amended <br />,~; by resolution No. bl - 25, passed February 7, 1961, and as assslnd®d by reso- <br />lution No. 61-1 1 , passed ~t~ , 1961, and in accord- <br />ance with tFie puns, specifications, estiss;ates and profiles heretofore approved <br />and now on file in the office of the Director of Public Service; ar~d referee <br />is swede to said plans and specifications for the character of the materials <br />which may be bid upon for said improvement, and for such purpose are by such <br />reference incorporated herein. <br />Section 2: That all claims for damages resulting therefrom that have <br />been legally filed shall be inquired into after the eoswpletion of the proposed <br />improvement, and the Solicitor shall. be, and he is hereby authorized and dir- <br />ected to institute legal proceedings in a court of competent jurisdiction to <br />inquire into arty claims that have bean so filed, <br />Section 3; That the entire cost of those sewers above designated as items <br />1l.t and 15 shall be assumed and paid by the City. That the entire cost of all of <br />the other sewers above described, to-wit, items 1 to 13, inclusive, less at least <br />one-fiftieth thereof and the cost of all intersections, shall be assessed in pro- <br />portion to the benefits which may result therefrom upon all lots and lands bound- <br />ing and abutting thereon. <br />That the cost o~ such improvement shall include the cost of <br />legal services and of obtaining an approving opinion, the expense of preliminary <br />and other surveys, and of printing and publishing the notices, resolutions and <br />ordinances required, the serving of such notices, and the costs of construction, <br />together with interest on notes and i~onds in anticipation of the tolls ction of <br />deferred assessments and other necessary expenditures. <br />Section ~t: That the assessments so to be levied shall be paid in twenty <br />annual installments, with interest on deferred payssents at the same rata as <br />shall be borne by the bonds to be issued in anticipation of the Collection thereof; <br />provided that the owner of any property assesssul may, at his option, pay st~cb <br />assessments in cash within thirty days after passage of the assessing ordinance. <br />Section ~: That bonds of the City shall be issued in anticipation of the <br />collection of assessments by instal]~ents and in an amount equal thereto and <br />notes of said City shall be issued in anticipation of the issue of such bonds <br />and the levy of such assessments. <br />Section b: That the remainder of the cost of said improvement, after <br />allocation of other City funds avaiI.abls therefor, and after application of <br />the assessments herein provided, together With coat of any real estate or in- <br />terest therein purchased or appropriated, the costs and expenses of arsy approp- <br />riation proceeding therefor, and damages awarded any owner of adjoihi.ng lands <br />with:~.interest thereon, toget-zer with the ousts and expenses of ancy such award, <br />shall be paid by the issuance of bonds in the manner provided by law. <br />Section 7: That the Director of Public Service be and he is hereby <br />authorized and directed as soon as the funds therefor are available to seeks <br />and execute a contract for said improvement with the lowest and. best bidder <br />after advertising according to law. <br />Section ti: This ordinance is hereby declared to be an emergency measure <br />necessary for the ismaediate preservation of the public peace, health and safety <br />of said City, and for the further reason that the imstsediate construction of said <br />improvement is necessary to protect the health of the inhabitants of the City; <br />
