w .~ RESOLUTION NO. 61 -/ ~ ~ A RESOLUTION DECLARING THE INTENTION OF COUNCIL TO APPROPRIATE CERTAIN EASE- ME~1TS FOR THE CONST~UC~'ION OF SEWERS AND DECLARING AN k~RGE1~Y ~'1~ ~l ~~ W~lEREAS, it is necessary in the judgment of this Council that immediate provision be made for the construction, maintenance and operation of certain sewers along, over and through certain property located in this city more fully hereinafter described, and WHEREAS, to provide in part the necessary rights of way required for such construction, maintenance and operation, it is necessary in the opinion of this Council that easements for the construction, operation and maintenance of said sewers be appropriated by the city. NOW THEREFORE BE IT RESOLVED by the Council of the City of North Olmsted, State of Ohio: Section 1: That it is deemed necessary and it is hereby declared to be the intention of this Council to appropriate a right of way and easement over, through and across each of the parcels of land described in Exhibit "A" attached hereto and made a part hereof for the purpose of constructing, maintaining, operating, repairing, altering, replacing, changing the size and removing a sewer together with the necessary manholes for the transportation of sewage with the right of unimpaired access to said sewer and the rights of ingress and egress on, over and through said parcels of land for all purposes necessary and inciden- tal to the construction, operation, maintenance, repair, altering, replacement, changing the size and removal of said sewer. There shall be reserved to the owners of the said parcels of land the right to fully use and enjoy said premises for all purposes consistent with. the full use and enjoyment by tMe city of the easement rights herein described but the construction of structures as defined in the Build- ing Code of the City of North Olmsted directly over any said sewer, except public utilities, is prohibited.
