<br />- 2 - <br />condition after any construction, maintenance, operation, repair, replacement <br />alteration, changing the size oP or removal of said sewer. Said right of way <br />and easement shall be over, through and aaross the northerly nine (9) feet of <br />the parcels described in Exhibit "A" and identified as the "Griffin Parcel", <br />the "Diehr Parcel", the"Van Duyke Parcel", and the "Passant Parcel", for <br />a permanent easement for the purposes above set forth with an additional ten <br />(10) Feet of temporary easement to the south of and parallel to said nine (9) <br />foot strip with the right to enter upon said additional ten (10) foot strip <br />with all necessary machinery, equipment and labor force for the purpose of <br />locating and constructing said sewer and upon the completion of said construc- <br />tion, the city's right to said temporary ten (10) foot easement shall termi- <br />nate. Said permanent easement shall be over, through and across the southerly <br />eight (8) feet of the parcel described and identified in Exhibit A as the <br />"Lockner Parcel" with an additional ten (10) feet of temporary easement to <br />the north of and parallel to said eight (8) foot strip for the purposes above; <br />set forth. Said permanent easement shall be over, through and across the <br />southerly ten (10) feet of the parcel described and identified in Exhibit A <br />as the "Schneider Parcel" with an additional ten (10) feet of temporary <br />easement to the north of and parallel to said ten (10) foot strip for the <br />purposes above set forth. <br />Section 2: That the Mayor be and he is hereby authorized and directed <br />to cause written notice of the passage of this Resolution to be given to the <br />owners of or persons in possession of or persons having an interest of record <br />in the above described real estate or to their authorized agents and said <br />notice shall be served according to law by a person to be designated for that <br />purpose by the Mayor and to make return of such service in the manner provided <br />by law. <br />Section 3: This Resolution is he±reby declared to be an emergency <br />_ _ ,..~.:.,, ~, .~. ,~..~,~,..~.F,~...w. _.,,..,..,,~,., .,..,,r,.._ .,,._ <br />
