.- <br />CITY OF NORTH OLMSTEI7 <br />OR~3I NANCE N:.. 62 ~~-- <br />By ~~ -x= <br />AN OR?<"iINANCE DETERMINING TO PROCEED WITH THE <br />CONSTRUCTION OF A WATER A'IAI:~f IN WALTER ROAD, <br />AND DECLARING AN EMERGENCY. <br />3E I'1 ORllAINE~7 by the Council of the City of <br />North Olmsted, State of Ohio: <br />Section 1: That it is hereby determined to proceed <br />with the installation and construction of a water main and <br />appurtenances thereto on Walter Road in the City of North <br />Olmsted and on Walter Road. in a portion thereof which lies <br />within the corporate limits of the City of Westlake in <br />accordance with Resolution No. 62-17 passed February 20, 19b2, <br />and in accordance with the plans, specifications, estimates <br />and profiles heretofore approved and now on file in the office <br />of the Director of Public Service, such plans and specifications <br />being incorporated herein by reference and reference being made <br />thereto for a statement of the character of. the materials which <br />may be bid upon for such improvement. <br />Section 2: That the estimated assessments against teach <br />lot or parcel of land to be assessed as prepared by the City <br />Engineer and heretofore filed with the Clerk of Council before <br />the passage of Resolution No. 62-17, in accordance with the <br />provisions of Revised Code Section 727.12, are hereby approved <br />and adopted, no claims for damages resulting from such improve- <br />ment and no objections to said estimated assessments having been <br />filed. <br />Section 3: That one-half the entire cost of said im- <br />provement shall be assessed upon the lots and lands bounding and <br />abutting upon the proposed improvement within the corporate limits <br />of the City of North Olmsted which said lots and lands are hereby <br />determined to be specially benefited by said improvement, and <br />the other one-half of the entire cost of said improvement shall <br />be the city's portion under the terms and conditions of its <br />agreement with the City of Westlake. <br />The cost of said improvement shall include the <br />cost of legal services and of obtaining an approving opinion, <br />the expense of preliminary and other surveys, of printing and <br />publishing the notices, resolutions and ordinances required, <br />the serving of slid notices and the cost of construction, to- <br />gether with the interest on notes and bonds issued in anticipa- <br />tion of the collection of deferred assessments and other necessary <br />expenditures. <br />Section 4: That all the assessments so to be levied <br />shall be paid in ten annual installments, with interest an de- <br />ferred payments at the same rate as shall be borne by the bonds <br />to be issued in anticipation of the collection thereof; provided, <br />however, that any such assessment in the amount of Five x$5.00) <br />Dollars or less, shall be paid in full, and not in installments, <br />at the time when the first or next installment would otherwise <br />become due and payable; provided,f urther, that the owner of any <br />property assessed may, at his option, pay such assessment in cash. <br />within thirty C30) days after the passage of the assessing <br />ordinance. <br />
