. <br />F <br />C <br /> <br />All as shown on Lhe plans hereinafter referred to, prepared by the City's <br />Consulting Engineers. Said sewers are to comprise a aewage collection system <br />for territory known as "Area 3" of the City of North OLasted and are to connect <br />into a trunk line sewer to be constructed in public easements and running from <br />a point in Barton Road approximately 561+ feet south of its intersection with <br />Lorain Road easterly about 2,090 feet and thence northerly about 712 feet, and <br />an interceptor sewer to be constructed in public easements and existing streets <br />? from a point approximately 1,395 feet west of Stearns Road, thence easterly, <br />intersecting Stearns Road about 2,613 feet south from Lorain Road, to Columbia <br />Road and thence northeasterlj? to Parklane, slso ee ahown on said plans. 3uch <br />trunk sewer and intercepting sever are to be peid for by the City and are not <br />to be assessed. <br />Section 2. It is hereby determined and declared that said improvement <br />is?conducive to the public health, convenience and welfare of ssid City and the <br />inhabitants thereof. Council further finda ond determines that said streets, <br />or parts thereof, to be so improved are so situated in relation to each other <br />tnat in order to corrrplete the improvement thereof in the most practical and h <br />economical me.nner they sha11 be improved at the same time, with the same kind <br />of ine,terials, and in the same menner. • <br />Section 3. That the grade of said streets and improvement shall be <br />the grade as shown by said Engineers' plans and profiles xhich are made a <br />part hereof. <br />Section 4. That the plans, specifications, estimates and profiles <br />of the proposed improvement, heretofore prepared by the Enginlers, and now on <br />file in the office of the Clerk of this Council, are hereby approved. <br />Section 5. That the whole cost of said improvement, less at least <br />one-fiftieth thereof and the cost of a11 intersections, shall be assessed upon <br />the f'ollowing described lots and lands in proportion to the benefits resulting <br />therefrom, ta-wit: <br />All lots and lands bounding and abutting upon the proposed improvement <br />between the termini aforesaid, except that with respect to the Southern Avenwe <br />sewers (item 13 of Section 1), the lots and lands to be assessed sha11 be those <br />only Which abut on the south side thereof, which said lots and lands are hereby <br />determined to be specially benefited by said iraprovement; and the cost of said <br />improvement shall include the cost of preliminary and other surveys, plans, <br />specificatior.s, profiles and estimates, and of printing, serving and publishing <br />notices, resolutions and ordinances, the amount of dam,%ges resi.ilting from the <br />improvement assessed in favor of any owner of land aftlcted by the improvement <br />and the interest thereon, the costs incurred in connection xith the preparation, <br />lexqtand collection of the special assesonents, the cost of purchasing, apprapri- <br />atiag and otherwise acquiring therefor any re4uired real estate or interests <br />therein, expenses of legal services including obtaining an approving legal <br />opinion, cost of labor and material, and interest on bonds and notes issued in <br />anticipation of the levy and collection of the special assessments, together With <br />all other necessary expenditures. <br />2
